Recreation, the California Board of Equalization, the Historic Resources Advisory <br />Committee, City, and any other appropriate governmental agency, as may be necessary <br />to determine owner's compliance with the terms and provisions of this Contract. In any <br />event, there shall be at least one inspection every five years by City's Planning Manager <br />and his/her designee. The first such inspection must occur within five years of the date <br />of this agreement. <br />e) Owner agrees to provide City with a report as to the status of the Historic <br />Property annually by January 31 of each year, which annual report shall provide <br />substantiation reasonably satisfactory to City's Planning Manager that Owner is in <br />compliance with the Contract. Such annual report will be on a form approved by the <br />City's Planning Manager and furnished to Owner by City. <br />f) Owner hereby agrees to and will comply with all applicable local, state, <br />and federal statutes, regulations, rules, codes (including building codes), ordinances, <br />and other requirements of governmental authorities now or hereafter in effect <br />("Applicable Laws") pertaining to the use of the Historic Property. Owner must give City <br />immediate written notice on Owner's becoming aware that the use or condition of the <br />Historic Property is in violation of any Applicable Law. <br />g) Owner or agent of Owner shall provide written notice of the contract to the <br />California Office of Historic Preservation within six (6) months of entering into this <br />Contract. <br />5. Provision of Requested Information. Owner hereby agrees to furnish City with <br />any and all information requested by City, which may be necessary or advisable to determine <br />compliance with the terms and provisions of this Contract. <br />6. Cancellation for Breach. City, following a duly noticed public hearing pursuant to <br />California Government Code Sections 50280, et seq., may cancel this Contract if it determines <br />that Owner breached any of the conditions of this Contract or that the property has changed to <br />the point that it no longer meets the standards for a qualified historic property.
