7.A. - Page 4 of 25 <br />Proposition 218 protest procedures, the District special assessments required to pay for each 5 -year <br />budget plan have been approved after a public hearing and consideration of protests pursuant to <br />Proposition 218 procedures. The City will continue to confer with Seaport Centre/Seaport Plaza property <br />owners on the development of maintenance budgets. However, because the CFD provides for the levy of <br />special taxes rather than special assessments, no future public hearings will be necessary if maintenance <br />budget increases require an increase in CFD special taxes. Increases in special taxes are not subject to <br />majority protest approval. <br />ENVIRONMENTAL REVIEW <br />On October 26, 2020, the City Council determined that the Seaport Levee -related actions were <br />categorically exempt from the requirements of the California Environmental Quality Act ("CEQA") because <br />these actions fall within each of the classes of projects that the Secretary for Resources has found do not <br />have a significant effect on the environment. These CEQA exemptions are set forth the State CEQA <br />Guidelines, 14 CCR §§ 15000, et seq., Sections 15301 (Class 1. Existing Facilities), 15302 (Class 2. <br />Replacement or Reconstruction), 15304 (Class 4. Minor Alterations to Land), and 15311 (Class 11. <br />Accessory Structures). This is because the project involves the repair of existing levees with no expansion <br />of the existing use and with the same purpose of the existing levees. Additionally, the project involves a <br />relatively minor amount of fill (6,050 cubic yards of net new fill imported) and does not involve the <br />removal of mature, scenic trees, or grading in a waterway. Finally, the project includes the construction <br />of a wall that is 2-4 feet in height on top of or behind existing walls, which is a minor structure accessory <br />to other levee systems on the site. <br />There is no applicable exception to the foregoing categorical exemptions. Specifically, the cumulative <br />impact of successive projects of the same type in the same place, over time is not significant, because <br />prior levee repair projects in this location have been minor in nature, and future similar projects are not <br />planned other than routine maintenance. In addition, there are no unusual circumstances regarding the <br />location of the levee project at Seaport Centre that would lead to significant effects on the environment. <br />Seaport Centre is similar to a number of commercial developments in the surrounding area that are <br />adjacent to San Francisco Bay. Finally, there are no historical resources or scenic highways in the vicinity, <br />and Seaport Centre is not a hazardous waste site on the Cortese List as described in Government Code <br />section 65962.5. <br />PUBLIC NOTICE <br />Public hearing notice was published more than 10 days in advance of the hearing, on December 24, 2020, <br />in the San Mateo Daily Journal. The public hearing notice was also posted in three conspicuous places <br />within the Maintenance District on December 18, 2020.
