7.A. - Page 11 of 25 <br />City, if appropriate; pay the County to levy and collect the special taxes; and, administer the CFD or any <br />bonds or other debt of the CFD. <br />The General Fund is not expected to incur any unreimbursed costs associated with the CFD or the <br />acquisition of the Levee Improvements. <br />ENVIRONMENTAL REVIEW <br />The creation of the CFD and approval and implementation of the Levee Financing and Improvement <br />Agreement are categorically exempt from the requirements of CEQA because these actions fall within <br />classes of projects that the Secretary for Resources has found do not have a significant effect on the <br />environment. These CEQA exemptions are set forth the State CEQA Guidelines, 14 CCR §§ 15000, et seq, <br />Sections 15301 (Existing Facilities), 15302 (Replacement or Reconstruction), 15304 (Minor Alterations to <br />Land), and 15311 (Accessory Structures). This is because the project involves the repair of existing levees <br />with no expansion of the existing use and with the same purpose of the existing levees. Additionally, the <br />project involves a relatively minor amount of fill (6,050 cubic yards of net new fill imported) and does not <br />involve the removal of mature, scenic trees, or grading in a waterway. Finally, the project includes the <br />construction of a wall that is 2-4 feet in height on top of or behind existing walls, which is a minor structure <br />accessory to other levee systems on the site. <br />There is no applicable exception to the foregoing categorical exemptions. Specifically, the cumulative <br />impact of successive projects of the same type in the same place, over time is not significant, because <br />prior levee repair projects in this location have been minor in nature, and future similar projects are not <br />planned other than routine maintenance. In addition, there are no unusual circumstances regarding the <br />location of the levee project at Seaport Centre that would lead to significant effects on the environment. <br />Seaport Centre is similar to a number of commercial developments in the surrounding area that are <br />adjacent to San Francisco Bay. Finally, there are no historical resources or scenic highways in the vicinity, <br />and Seaport Centre is not a hazardous waste site on the Cortese List as described in Government Code <br />section 65962.5. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />Reject the Levee Financing and Improvement Agreement and formation of a Seaport Centre/Seaport Plaza <br />Community Facilities District for purposes of improving and expanding the levee system at Seaport <br />Peninsula.
