7.A. - Page 15 of 25 <br />FISCAL IMPACT <br />The property owners have agreed to pay all professional fees incurred by the City in connection with <br />formation of the CFD and to pay for all annual costs associated with administering the special tax. <br />A facilities special tax will be levied in the CFD over 15 years to finance the City's purchase of (i) <br />improvements to the Seaport Centre Levee that are necessary for FEMA to accredit the Seaport Centre <br />Levee and (ii) a levee and related flood protection facilities along the perimeter of Seaport Plaza facing <br />Redwood Creek. A perpetual services special tax will be levied to finance the ongoing operation and <br />maintenance of the Seaport Centre and Seaport Plaza levees and the storm drain, sewer and water <br />facilities serving Seaport Centre currently maintained and operated by the City with funds from the <br />Seaport Centre Maintenance District. <br />The General Fund is not expected to incur any unreimbursed costs associated with the CFD. <br />ENVIRONMENTAL REVIEW <br />The creation of the CFD and Seaport Levee -Related Actions are categorically exempt from the <br />requirements of the California Environmental Quality Act ("CEQA") because these actions fall within each <br />of the classes of projects that the Secretary for Resources has found do not have a significant effect on <br />the environment. These CEQA exemptions are set forth the State CEQA Guidelines, 14 CCR §§ 15000, et <br />seq, Sections 15301 (Class 1. Existing Facilities), 15302 (Class 2. Replacement or Reconstruction), 15304 <br />(Class 4. Minor Alterations to Land), and 15311 (Class 11. Accessory Structures). This is because the project <br />involves the repair of existing levees with no expansion of the existing use and with the same purpose of <br />the existing levees. Additionally, the project involves a relatively minor amount of fill (6,050 cubic yards <br />of net new fill imported) and does not involve the removal of mature, scenic trees, or grading in a <br />waterway. Finally, the project includes the construction of a wall that is 2-4 feet in height on top of or <br />behind existing walls, which is a minor structure accessory to other levee systems on the site. <br />There is no applicable exception to the foregoing categorical exemptions. Specifically, the cumulative <br />impact of successive projects of the same type in the same place, over time is not significant, because <br />prior levee repair projects in this location have been minor in nature, and future similar projects are not <br />planned other than routine maintenance. In addition, there are no unusual circumstances regarding the <br />location of the levee project at Seaport Centre that would lead to significant effects on the environment. <br />Seaport Centre is similar to a number of commercial developments in the surrounding area that are <br />adjacent to San Francisco Bay.
