FIRST AMENDMENT TO STORMWATER TREATMENT MEASURES MAINTENANCE <br />AGREEMENT <br />THIS FIRST AMENDMENT TO Stormwater Treatment Measures M 'ntenanc reement, <br />1831 East Bayshore Road, ("First Amendment') is made and entered into this Aday o LU*� <br />2023 ("Effective Date"), by and between Fontwerth Enterprises, LLC, a California limito liability <br />company ("Property Owner"), and the CITY OF REDWOOD CITY, a charter city and California <br />municipal corporation ("City"). <br />RECITALS <br />A. The Property Owner and City entered into that certain Stormwater Treatment Measure <br />Maintenance Agreement dated October 12, 2020 and recorded November 10, 2020 as instrument Number <br />2020-126192, in the Official Records of the County of San Mateo ("Original Stormwater Treatment <br />Measures Maintenance Agreement'). <br />B. The Property Owner is the owner of real property commonly known as 1831 East <br />Bayshore Road, Redwood City, CA 94063 (the "Property"), as more particularly described in Exhibit <br />"A", attached to and incorporated by this reference in Recital C of the Original Stormwater Treatment <br />Measures Maintenance Agreement. <br />C. The Original Stormwater Treatment Measures Maintenance Agreement included <br />references to a legible reduced -scale copy of the site plan showing the stormwater treatment measures that <br />are to be located or constructed on the Property ("Site Plan") and installed and maintained by the Property <br />Owner as shown on Exhibit "B", attached to the Original Stormwater Treatment Measures Maintenance <br />Agreement. <br />D. The Original Stormwater Treatment Measures Maintenance Agreement included <br />references to a copy of the Stormwater Treatment Operation and Maintenance Inspection Report <br />describing the stormwater treatment measures that are to be located and maintained on the Property <br />("Inspection Report") by the Property Owner as shown on Exhibit "C", attached to the Original <br />Stormwater Treatment Measures Maintenance Agreement. <br />E. Since the recordation of the Original Stormwater Treatment Measures Maintenance <br />Agreement, a revised plan for the site has been reviewed and approved by City staff which alters the <br />stormwater treatment measures on the site. The Property Owner requested these modifications to the <br />stormwater treatment measures, and in doing so, the Property Owner was required by City to alter the <br />Site Plan and Inspection Report with this First Amendment. <br />F. The revised Site Plan and Inspection Report is further detailed on Revised Exhibit " B" <br />and Revised Exhibit "C" respectively to this First Amendment. <br />NOW, THEREFORE, the Property Owner and City hereby amend the Original Stormwater <br />Treatment Measure Maintenance Agreement as follows: <br />1. Exhibit "B" and Exhibit "C" to the Original Stormwater Treatment Measures <br />Maintenance Agreement are of no further force and effect and are hereby replaced with Revised Exhibit <br />"B" and Revised Exhibit "C" attached hereto and incorporated by reference. <br />2.
