EXHIBIT "A" <br />SCOPE OF SERVICES <br />1. Consultant agrees to perform the following services: <br />A. Reports. Each calendar quarter starting on the first full quarter commencing upon <br />execution of this Agreement and adoption of an accompanying CDTFA Resolution, <br />Consultant will provide to City: <br />• Audit Status Report — update on progress of all open and outstanding <br />audit petitions before the CDTFA. <br />B. Sales Tax Forecast. Consultant will annually provide an updated sales tax forecast <br />and analysis of the City's sales tax and economic performance. City will select the <br />quarter that City wants to receive the updated forecast. The forecast will be <br />provided on each anniversary of the quarter. <br />C. Consultant will comply with Section 7056 of the Revenue and Taxation Code. <br />Consultant understands and acknowledges that: <br />Consultant is authorized by this Agreement to examine sales or <br />transactions and use tax records of the California Department of Tax and <br />Fee Administration (formerly State Board of Equalization) (CDTFA) <br />provided to County pursuant to contract under the Bradley -Burns <br />Uniform Sales and Use Tax Law and California Revenue & Taxation Code <br />applicable to sales or transactions and use taxes. <br />ii. Consultant is authorized to disclose information contained in, or derived <br />from, those sales or transactions and use tax records only to those City <br />officers or employees who have been authorized by resolution to <br />examine such information. This Agreement does not authorize <br />Consultant to disclose such information to any other persons. <br />iii. Consultant is prohibited from performing consulting services for a retailer <br />during the term of this Agreement. <br />iv. Except for those retention requirements set forth in the Original Sales Tax <br />Audit and Analysis Agreement dated July 15, 2015, Consultant is <br />prohibited from retaining the information contained in, or derived from, <br />those sales or transactions and use tax records, after this Agreement has <br />expired. <br />2. The City agrees: <br />A. City will provide to the CDTFA a resolution authorizing Consultant to receive the <br />sales, transaction, and use tax data, along with a copy of this Agreement. <br />REV: 11-23-2020 EI <br />ATTY/AGR.2020.268/MuniServices LLC (Page 11 of 35) <br />
