ORDINANCE NO. P-282 ORDINANCE OF THE BOARD OF PORT COMMISSIONERS OF THE CITY OF REDWOOD CITY APPROVING AND AUTHORIZING EXECUTION OF FIRST AMENDMENT TO LEASE AGREEMENT WITH SIMS GROUP USA CORPORATION DBA SIMS METAL MANAGEMENT BE IT ORDAINED BY THE BOARD OF PORT COMMISSIONERS OF THE CITY OF REDWOOD CITY, AS FOLLOWS: Section 1. Public hearing having been duly noticed for, and held on January 13, 2021, on the question of approval of an amendment to lease agreement entitled "Lease Agreement (Sims Group USA Corporation dba Sims Metal Management)" and dated April 25, 2018 (the "Lease"), and pursuant to the provisions of Section 48 of the Charter of the City of Redwood City, the Board of Port Commissioners of the City of Redwood City does hereby approve that certain amendment to lease agreement entitled "First Amendment to Lease Agreement (Sims Group USA Corporation, dba Sims Metal Management)" (the "First Amendment"), by and between the City of Redwood City, acting by and through its Board of Port Commissioners ("Port") and Sims Group USA Corporation, dba Sims Metal Management ("Tenant"), which First Amendment provides that the premises (the "Recycling Premises") which are subject to the Lease are located at the Port of Redwood City, in Redwood City, CA, and consist of several parcels of land, a Wharf Access area, and an incidental easement area, and all facilities located thereon, which Premises are generally described and depicted on Attachment "A," attached hereto, and shall be used for the purpose of operating a full service recycling facility for various scrap material P-282 1
