PERiODiC ADJUSTMENT OF DOWNTOWN METER ZONE METER <br /> RA,TES: Under the authority of California Vehicle Code sec#ion 22508, the City Councif <br /> hereby adopts the foliowing process for adjusting Downtown Meter Zone meter rates <br /> #rom time to t'sme to manage the use and occupancy of ths parking spaces for the public <br /> benefit in al! parking areas within the Downtown Meter Zone. <br /> A. To accomplish the goal of managing the supply of parking and ta make it reasonably <br /> available when and where needed, a target occupancy rate of eighty-five percen#(85%) <br /> is hereby established. <br /> B. At teast annually and not more frequentty than quarte�ly, the City Manager shall <br /> survey the average occupancy for each parking area in the Downtown Meter Zone that <br /> has parking meters. Based on #he survey resul#s, the City Manager shail adjust the <br /> rates up or down in #wenty-five cen# ($0.25) intervals to seek to achieve the target <br /> occupancy rate. The base parking meter ra#e, and any adjustmen#s to that rate made <br /> pursuant ta #his ordinance, shal( become effective upon the programming of the parking <br /> meter for that rate. A current schedule o# meter rates shall be available at the City <br /> Clerk's office. <br /> G. The haurty meter rate shail not exceed o�e dollar and fifty cents �$1.50} without the <br /> express approval of the Cit�r CounciL <br /> D. This Sec#ion does not apply #o the parking facilities described in Section 2Q.119 of <br /> this Division during #he"peak hours." <br /> Sec. 20.133. PROVISIONS FOR TEMPORARY SUSPENSION OF METER RATES: <br /> The provisions of this Division may be suspended from time to time by motion of the <br /> City Council in any case where the Council finds that st�ict compliance would not serve <br /> the public interest, including but not limi#ed ta the use af public streets and sidewalks for <br /> celebrations, special public events, celebra#ion of holiday seasons and any other such <br /> activity ar purpose as#he City Cauncil in its sole discretion shall determine. <br /> Sec. 20.134, DEFINITI�JNS: For the purposes of#his Division the following words and <br /> phrases shall have the meanings respectively ascribed ta them by this Section: <br /> OPERATOR: Every individua! who shali operate a vehicie as the owner thereo# or as <br /> the agent, employee or permittee of the owner. <br /> PARKING METER: Any mechanical device which accepts payment for the use of <br /> parking spaces as described in this Division. Such mechanicat devises shali include but <br /> not be limited to conventional parlcing meters, pay-by-space machines, pay-and-display <br /> machines, and pay-on-foot machines. <br /> STREET: Any public street, avenue, road, baul�vard, highway or o#her pubtic place <br /> loca#ed in #he City and established for the use of vehicles. <br /> Atry/Ord/Ord.302 fi <br /> 042208 <br />
