6.1 G <br /> Page 1 <br /> �_ ������ ` <br /> To �he i�e+deveiopm�nt�gency Boarc! <br /> ��m The ��ecutr� D��ect r <br /> May 12, 2008 <br /> Su�ECT <br /> Courthouse Square Pavilion Lease <br /> RECOMMENDATION <br /> By motion, authorize the Redevelopment Agency to execute a month-to-month iease <br /> with Nancy Radcliffe doing business as "Lulu's" for Lease Area 2B in Courthouse <br /> Square <br /> BACKGROUND <br /> Nancy Radcliffe, sale propriefar af Lulu's on Main Street, cantacted staff requesting the <br /> temporary use of Lease A�ea 2B at Courthouse Square to operate a retail concession <br /> called Lulu's for limited haurs during the summer and fail months. Lulu's will seil <br /> periodicals, gift items, fresh flowers, plants, and sundries such as batteries, film, <br /> disposabie cameras, aspirin, tozenges, candy, and gum. Since Lease Area 2B is <br /> cufrerrtly unaccupied, the proposed temporary use by Ms. Radcliffe would activate this <br /> space while staff pursues iong-term use of the three unleased pavilian spaces. At the <br /> time of preparing this report, more than finrenty individuals have expressed interest in <br /> lease opportunities. Staff plans to issue a request for quai�ca#ions this quarter to seek <br /> quali�ed vendors. <br /> The projected opening date of Lulu's is late May 2008 with the following business <br /> haurs: Tuesday and Wednesday, 1 Q am to 3 pm; Thursday and Friday, 10 am to 8 pm; <br /> ared Saturclay, 1Q am to 4 pm_ Ms. Radcliffe proposes to extend the business hau�s <br /> during special events. The key terms of the lease consist of a: 1) month-to-month tease <br /> and 2) monthly rent of $411.00. The rent collected will fund Agency sponsflred or co- <br /> sponsored dawntown special events, as well a portion of the maintenance of <br /> Courthouse Square such as power washing and grounds keeping. Afl connections, <br /> charges and assessments for water, sewer and electricity associated wi#h the ope�atian <br /> of Lulu's wiil be paid by Ms. Radcliffe. <br /> If the Agency en#ers irtto a Lease with a longer term tenant for Lease Area 2B, the <br /> Agency will notify Nancy Radciiffe that she will have the option to ei#her relocate to <br /> anothe�- vendor space, if avaiiable, or terminate her lease at the expiration o# the 30 <br /> calendar day time period. A License for the area immediately outside Lease Area 2B <br /> will nat be required as this Lease is both short-term and does no# entail the sale of food <br /> and beverages. <br /> ALTERNATIVES <br /> Do not approve the execution af the Lease with Nancy Radcliffe. <br />
