Lessee agrees that if Lessee does not <br /> maintain any insurance policy required under this Agreement ar fails to pay any <br /> premiums when due, Lessar may, at its election, efther terminate this Agreemenf, <br /> require that the Premises be immediately ctosed for business pending <br /> reinstatement of insurance by lessee, or obtain the necessary insurance and pay <br /> the premium and the repayment thereof shal) be deemed to be additionai rent <br /> due by the Lessee and payable on the next date upon which a payment of rent is <br /> due. <br /> 30. BUSlNESS LICENSE <br /> 30.1 Prior to the opening da#e, Lessee must obtain a valid Redwood City Business <br /> License for the assignec!Leased Area at Courthause Square. <br /> 31. TERMlNATiON <br /> 31.1 Lessor may terminate this Agreement by giving written notice to Lessee af least <br /> thirty(3Q}days prEor ta the intended termination date. <br /> 39.2 Opportunity to Cure Non-Manetary Breach. Lessor's notice to terminate must <br /> state the nan-manetary terms that the Lessee has breached, and must pravide <br /> Lessor with 15 days to cure the breach. !f the breach cannat be cured within 15 <br /> days, the Lessee shall notify the l.essor of the reasons why#he breach cannat be <br /> cured within the 15 day period, and shalf prapose a specific plan and schedule to <br /> cure the breach. The cure proposed by the Lessee must be diligently pursued to <br /> comptetion. <br /> 31.3 Oppartunity to Cure Manetary Breach. If Lessee's breach involves the non- <br /> payment of rent or other charges, Lessor's notice to terminate must state the <br /> receivables due and must provide Lessee wi#h 5 days to cure the breach. <br /> 31.4 If Lessee terminates #his Agreement prior to the expiratian of the current Lease <br /> term, Lessee shalf be responsible for rent for the remainder of the Lease term. <br /> 32. ABANDONMENT AND NOTICE <br /> 32.1 Lessee shall not vacant ar abandon the Leased Premise at any time during the <br /> term hereof; and i# Lessee shaf! abandon, vacate or surrender the Leased <br /> Premises, ar be dispossessed by process of law or otherwisa, i� shall be a <br /> materiat default under this Agreement. The term "abandoned" as used herein <br /> means vacation of the Leased Premises by Lessee or any sublessee or assignee <br /> of Lessee far a period of more ttian six(6) consecutive normai business days. <br /> 32.2 The Premises shalf be deemed abandoned by the Lessee, within the meaning of <br /> Civil Code Sectian 1951.2, and the lease shall terminate, if the Lessor gives <br /> written notice of his or her belief af abandonment, as provided in Civil Code <br /> Section 1951.3, and the Lessee fails to give the Lessor writtert natice, before the <br /> date c�f termination specified in the Lessor's notice, stating fihat he or she does <br /> not intend to abandon the real property, and stating an address at which the <br /> Lessee may be served by certified mail in any action far unlawfui detainer of the <br /> Premises. <br /> 32.3 The Lessor's notice of belief af abandonment shall be personally delivered ta the <br /> Atty/Agr/2008.033 �g <br /> 0505d8 <br />
