In most cases, the City requires the property owners <br />to obtain a Planned Development Permit to ensure proper engineering <br />and aesthetic controls for these types of improvements. Most homeowner <br />associations in Redwood Shores also provide design review of these <br />types of improvements. <br /> <br />If the initiative passed, the Planning Division would continue to approve <br />these uses through the existing process, without the two-thirds voter <br />approval requirement. However, a dispute could arise if an improvement, <br />such as a dock, extended into the lagoon waters with a general plan <br />designation of Controlled Watervvay. In that case, someone intent on <br />blocking the construction of a dock or other improvement could argue that <br />land covered by the initiative is affected and the two-thirds voter approval <br />provision applies because a dock is not an "Open Space" use under the <br />initiative. <br /> <br />10. Would the Charter initiative apply to the property north of the San <br />Carlos airport? <br /> <br />Response: No. This land is currently being used as a safety zone for the San Carlos <br />Airport and has a general plan land designation of Unimproved Areas <br />(Land or Water) and a zoning designation of Commercial Park. Thus, the <br />initiative would apply to the land because of its general plan designation. <br />The land is owned by San Mateo County, however, and is therefore <br />exempt from the initiative. <br /> <br />11. Could the City build a senior center or public housing on the parking <br />lot of Red Morton Park? <br /> <br />Response: The City could not build housing on the lot and it probably could not build <br />a senior center. While the parking lot at Red Morton Park has a zonig <br />designation of R-2 Residential Duples, it has a general plan designation of <br />Park and would therefore be covered by the initiative. A senior center <br />project probably could not be constructed on the existing parking lot <br />without two-thirds voter approval. The initiative would only allow the Open <br />Space use of "public parks and public recreation areas or facilities", <br />Consistent with the discussion in the May 19, 2008 staff report, it would <br />appear that a senior center would not constitute an Open Space use. <br />Thus, two-thirds voter approval by the people of Redwood City would be <br />required. Public housing also could not be built on the site without two- <br />thirds voter approval, since housing does not qualify as an "Open Space" <br />use under the initiative. <br /> <br />12. What lands within the Port of Redwood City would be affected by the <br />Charter initiative, especially in light of the letter from the Chamber of <br />Commerce? <br /> <br />8 <br />
