Vanderlinden, City Clerk of the City of Redwood City, do hereby certify that: <br /> <br />1. On Wednesday, May 28, 2008 at 11 :20 a.m., Mr. Ralph Nobles submitted to the <br />OffICe of the City Clerk an Initiative Petition entitled: "A CITY CHARTER <br />AMENDMENT REQUIRING A TWO-THIRDS VOTE Of CITY VOTERS <br />TO CHANGE THE GENERAL PLAN DESIGNATION OR ZONING <br />ORDINANGE USES FOR CERTAIN LANDS IN THE CITY". <br />2. In accordance with California Elections Code sections 9255(c) and 9210(a)t the <br />County Election officials' last relevant official report of registered voters in the <br />City of Redwood City was 35,123. A charter initiative shall be signed by not less <br />than 15 percent of sard registered voters. Thus, the petition was required to be <br />signed by not less than 5,268 registered voters. <br />3. In accordance with California Elections Code sections 9210 and 9266, I accepted <br />and examined the Petition that was filed with my office. <br />4. The Petition sections contained 8,124 unverified signatures. One Petition section <br />with 20 signatures was withheld from the verification process because it was not <br />securely fastened as required by law. (Elec. Code, 9 9263.) <br />5. In accordance with California Elections Code section 9114, I have examined, or <br />caused to be examined. the signatures on the Petition sections and found 6,527 <br />were valid signatures; <br />6. Based on this examination and in accordance with Elections Code sections 9114 <br />and 9266, the Initiative Petition is hereby acknowledged as sufficient and certified <br />as such this 20th day of June 2008; <br />7. The Petition is being certified as sufficient notwithstanding the fact that a review <br />of the Petition sections by the San Mateo County Elections Office found that <br />4.174 of the 8,105 unverified signatures appear on Petition sections that were not <br />circulated by a voter or a person qualified to register as a voter of the City of <br />Redwood City, in violation of Elections Code sections 9261 and 9209. That <br />requirement. however. has been found to be unconstitutional by a California <br />Court of Appeal and therefore is not being relied upon. (See Preserve Shorecliff <br />Homeowners v.
