<br />Yet a third option would be to amend the Charter or Zoning Code to require a majority <br />vote for any changes to the Zoning Code designations covering Cargill land , namely the <br />"Tidal Plain" designation. This proposal would not affect the New General Plan but <br />would apply to lands beyond Cargill, including Docktown. <br /> <br />All of these proposals could be flexible about how they are amended in the future. If an <br />initiative is silent about how it is to be amended, it could only be amended by a <br />subsequent vote of the electorate. However, an initiative could also permit City Council <br />to make subsequent amendments if it so provided. (See, e.g., Elec. Code, S 9217 [no <br />initiative ordinance "shall be repealed or amended except by a vote of the people, <br />unless provision is otherwise made in the original ordinance.l.) These provisions can <br />be drafted broadly (to always permit City Council amendment), narrowly (to prohibit City <br />Council amendment or only if such amendment furthers the purpose of the measure) or <br />anything in between. <br /> <br />78 <br />Page 5 <br /> <br />B. An Initiative Reauirina a Maio"tv Vote <br /> <br />A second option would be to simply require a majority vote for any changes to the use <br />of lands set forth in the proposed Charter amendment initiative. <br /> <br />This proposal would be very similar to the proposals discussed above only it would not <br />limit voter ratification to Cargill lands and would instead extend the requirement to all of <br />the lands listed in the proposed Charter amendment initiative, including City parks, Area <br />H, Docktown, the SBSA treatment facility, Oracle property, County-owned land, waters <br />around the Port, and the Redwood Shores lagoon. <br /> <br />C. Advisory Measures <br /> <br />City Council could also place one or more advisory measure on the ballot. An advisory <br />measure would not be binding on the City Council. Moreover, since it is not a binding <br />ordinance or charter measure, it could not be considered a competing initiative <br />rendering the proposed Charter amendment initiative void, assuming it received more <br />votes then the proposed Charter amendment initiative. Put otherwise, an advisory <br />measure will not have any binding effect, either on its own or with respect to the <br />proposed Charter amendment initiative. <br /> <br />With that in mind, several options for an advisory measure include: <br /> <br />1. A measure supporting a more comprehensive public process for making <br />Mure land use decisions on lands designated in the proposed Charter <br />amendment initiative, including City-run workshops and community <br />meetings. <br />2. a measure supporting more open space in the City, including the <br />acquisition of property for that purpose, and proposing funding alternatives <br />for such acquisition. <br /> <br />5 <br />
