<br />1. Improvements. Owner shall, at its own cost and expense, construct all of <br /> <br />the improvements ("Improvements"), furnish all the materials, and do all the work <br /> <br />hereinafter described in accordance with, and as provided for in, the plans prepared for <br /> <br />Owner by Kier & Wright Civil Engineers and Surveyors, Inc., entitled, "Street <br /> <br />Improvement Plans, Middlefield Road" as well as City's revised specifications entitled, <br /> <br />"Engineering Standards of the City of Redwood City", adopted December 4, 2006 which <br /> <br />plans and specifications are on file in the office of the City Engineer, Engineering and <br /> <br />Construction. Said Improvements shall also be constructed in strict compliance with the <br /> <br />provisions of Article VII, Chapter 29 of the Code of the City of Redwood City. If a <br /> <br />conflict exists between the plans and specifications and said Chapter 29 in regard to the <br /> <br />standard for a particular improvement, the stricter standard shall govern to the extent of <br /> <br />such conflict. Owner shall complete all of the Improvements, subject to such exceptions <br /> <br />and time extensions allowable under paragraph 10, on or before March 10, 2009. The <br /> <br />Improvements shall include, but are not necessarily limited to, all of the following: <br /> <br />(a) grading, paving <br />(b) curbs, gutters, sidewalks <br />(c) water system, complete <br />(d) sewer system, complete <br />(e) storm drainage system, complete <br />(f) landscaping and irrigation system, complete <br />(g) signing, striping, markings, complete <br />(h) site lighting, complete <br />(i) traffic signals, complete <br /> <br />ATTY/AGR/2008.014 <br />030308 <br /> <br />2 <br /> <br />J <br />
