Exhibit C <br /> Performance <br /> 1. Redwood City will provide a one-year warranty on any installation or upgrade of <br /> software applications perFormed by the Software Development staff. Hours will <br /> not be charged when time is spent in correcting problems provided the problems <br /> are not attributable to either a third-party software vendor or East Palo Alto, <br /> which includes but is not limited to lack of end-user testing, lack of adequate test <br /> scenarios, or lack of adequate exception scenarios. Both Parties will agree to <br /> the project scope prior to the starting the project. <br /> 2. Redwood City will not delete or destroy any East Palo Alto records without <br /> written authorization from East Palo Alto unless pursuant to a schedule approved <br /> by East Palo Alto. <br />
