<br />Page 11 <br />is City's proportionate share based on area occupied in the building) of the cost of repairs and <br />maintenance provided for in Part II, Section 6 of this Agreement. City agrees to reimburse County <br />for 100% of the cost of any repairs or maintenance that are performed for the sole benefit of, that <br />are performed on the interior improvements of the Ubrary or are performed on equipment or utilities <br />servicing only the Ubrary, whether the work is performed by the County or by contract. Such repairs <br />and maintenance may be initiated by the County or by request of the City to the County in writing. <br />Prior to commencing work to be done for the sole benefit of the Ubrary estimated to cost over $500, <br />County shall notify City in writing and secure its written approval, which shall not be unreasonably <br />withheld. The City will pay any cost resulting from the required moving of any Ubrary contents or <br />equipment, as identified in Part II, Section 3 of this Agreement. <br /> <br />5. REIMBURSEMENT FOR COST OF REMODELING. City shall reimburse County for certain costs <br />of remodeling of the Building as follows: <br />0) Building Shell Renovation. City shall reimburse County for renovation of the building <br /> <br />. . <br />shell in an amount not to exceed $216,000 ($66 per square foot). The parties agree that this is an <br />estimate and if actual costs are less than $216,000 ($66 per square foot) City's obligation shall be <br />reduced accordingly. Said building shell renovation cost reimbursement shall be paid in four annual <br />installments according to the following schedule: <br /> <br />Due date <br /> <br />Amount due <br /> <br />May 1, 1995 <br />January 1, 1996 <br />January 1, 1997 <br />January 1, 1998 <br /> <br />$76,000 <br />$50,000 <br />$45,000 (or remainder of final cost if less than $45,000) <br />$45,000 (or remainder of final cost if less than $45,000) <br /> <br />(ii) Ubrarv Improvements. City shall pay for actual costs of Ubrary improvements <br />commonly referred to as tenant improvements and described in the plans and specifications dated <br />December 6, 1994, and subsequent addenda, on file in the office of the County Manager. Upon <br />execution of this Agreement these costs were estimated at $308,000 which includes a 7% <br />contingency. Upon execution of this Agreement, City shall pay County the estimated $308,000. <br />Upon completion of the building remodel County shall prepare a final accounting of the remodel <br />costs and shall bill City for the actual costs of the Ubrary improvements.
