<br />~ -"- .. <br /> <br />RepORT <br /> <br />6.1B <br />Page 1 <br /> <br /> <br />July 21,2008 <br /> <br />SUBJECT <br />Amendment No. 3 to the 2005-2006 Comprehensive Street Tree Maintenance <br />Agreement with The Professional Tree Care Company, Inc. <br /> <br />RECOMMENDATION <br />Approve by motion, Amendment NO.3 to the 2005-2006 Comprehensive Street Tree <br />Maintenance Agreement with The Professional Tree Care Company, Inc. in the amount <br />of $230,333, and authorize the City Manager to increase the contract amount, if <br />necessary, up to 10% of the amount awarded. <br /> <br />BACKGROUND <br />On October 25, 2005, the contract was awarded to The Professional Tree Care <br />Company, Inc. of Berkeley, CA in the amount of $218,595, for the 2005-2006 <br />Comprehensive Street Tree Maintenance Program. Language in the Agreement <br />allowed for up to four consecutive one-year extensions. On February 1, 2007, <br />Amendment No. 1 was issued to extend the Agreement through August 31, 2007, in the <br />amount of $218,595. On June 6,2007, Amendment Number 2 was issued to extend the <br />Agreement through August 31, 2008 in the amount of $224,060. With this Amendment <br />the total aggregate Agreement amount shall not exceed $891,583. The contractor has <br />performed their work to accepted industry standards and staff is confident they will <br />continue to perform work in compliance with accepted industry standards. <br /> <br />ALTERNATIVES ~!"'. <br />Do not permit the Amendment to the Agreement and direct staff to re-bid the entire <br />project. <br /> <br />FISCAL IMPACT <br />Funds are available in the FY 2008-2009 Public Works Services Street Tree <br />Maintenance Budget.
