~ -"- .. RepORT 6.1B Page 1 July 21,2008 SUBJECT Amendment No. 3 to the 2005-2006 Comprehensive Street Tree Maintenance Agreement with The Professional Tree Care Company, Inc. RECOMMENDATION Approve by motion, Amendment NO.3 to the 2005-2006 Comprehensive Street Tree Maintenance Agreement with The Professional Tree Care Company, Inc. in the amount of $230,333, and authorize the City Manager to increase the contract amount, if necessary, up to 10% of the amount awarded. BACKGROUND On October 25, 2005, the contract was awarded to The Professional Tree Care Company, Inc. of Berkeley, CA in the amount of $218,595, for the 2005-2006 Comprehensive Street Tree Maintenance Program. Language in the Agreement allowed for up to four consecutive one-year extensions. On February 1, 2007, Amendment No. 1 was issued to extend the Agreement through August 31, 2007, in the amount of $218,595. On June 6,2007, Amendment Number 2 was issued to extend the Agreement through August 31, 2008 in the amount of $224,060. With this Amendment the total aggregate Agreement amount shall not exceed $891,583. The contractor has performed their work to accepted industry standards and staff is confident they will continue to perform work in compliance with accepted industry standards. ALTERNATIVES ~!"'. Do not permit the Amendment to the Agreement and direct staff to re-bid the entire project. FISCAL IMPACT Funds are available in the FY 2008-2009 Public Works Services Street Tree Maintenance Budget.
