<br />6.1E <br />Page 1 <br /> <br />R.EPORT <br /> <br />To the Honorable Mayor and City Council! <br />From the, Cit Mana ~r <br /> <br />July 28, 2008 <br /> <br />SUBJECT <br />Cost sharing agreement with the South Bayside System Authority for improvements to <br />the Redwood Shores Levee Segment III <br /> <br />RECOMMENDATION <br />Approve, by motion, the proposed cost sharing agreement with the South Bayside <br />System Authority (SBSA) for improvements to the Redwood Shores Levee Segment III <br />and authorize the City Manager to execute the same. <br /> <br /> <br />BACKGROUND <br />The City has an on-going interest in securing Federal Emergency Management Agency <br />(FEMA) certification for all Redwood Shores levees. Levees within the undeveloped <br />"Area H" parcel and Levee Segment III remain the two levee sections that require <br />improvements to qualify for FEMA certification (see attached map). Segment III <br />improvements could not be performed eight years ago as part of the City's Levee <br />Improvement Program because regulatory agencies 1 and the SBSA could not finalize the <br />alignment of the levee. Regulatory agencies want the levee relocated onto SBSA <br />property, further from sensitive wildlife habitat. SBSA wants the levee to remain in its <br />existing location which optimizes SBSA's usable land and provides protection for SBSA's <br />. .internal...drainagesystem; ....However;the City's various existing permits issued. ..bythe <br />regulatory agencies will not allow the levee configuration preferred by SBSA. As result, <br />SBSA has agreed to be responsible for the permitting and the construction of the levee <br />improvements in compliance with FEMA standards if the City agre.es to fund the project. <br /> <br />The proposed agreement outlines roles and responsibilities of the SBSA and Redwood <br />City for the improvements to the Redwood Shores Levee Segment III. If Council <br />approves the proposed agreement, the City will transfer $565,000 to SBSA for the <br />design, administration, and construction of levee improvements. This funding amount is <br />consistent with the cost estimate provided by the design engineer. If unforeseen <br />conditions occur that increase the costs beyond the funding amount, staff will renegotiate <br />the overage with SBSA at that time and an amendment to the agreement will be <br />presented for Council's approval. Any funds unexpended at the conclusion of the project <br />will transfer back to the City. <br /> <br />The levee will be designed such that it can be certified by the City to be compliant with <br />FEMA regulations. The City will have oversight authority of the entire project, and the <br />title of the improvements will be transferred to the City at the conclusion of the project. <br />Completion of construction is anticipated before the end of this year. <br /> <br />. 1 U.S. Corp of Engineers, U.S, Fish and Wildlife Services, California Fish and Game, Regional Water <br />Quality Control Board, Bay Conservation and Development Commission, and the Environmental <br />Protection Agency. <br />
