<br />8A <br />Page 3 <br /> <br />Section 6a. Voter Approval Requirement for Development of the Cargill Saltworks <br />Area <br /> <br />A. V oter Approval <br /> <br />Any City Council legislative action permitting or approving development of the Cargill <br />Lands shall not be effective until ratified by a majority of Redwood City voters at a <br />general or special municipal election. <br /> <br />B. Definitions <br /> <br />For the purposes of this Section 6a, the following definitions shall apply: <br /> <br />1. "Cargill Lands" means approximately [the 1,433-acre site] 1.450 acres ofthe <br />[former] Cargill industrial salt plant and ponds, located east of Highway 101 and south <br />of Seaport Boulevard. This property is described by the following Assessor Parcel <br />numbers: 054-300-230; 054-300-670; 054-310-100; 054-310-120; 054-310-140; 054- <br />310-160; 055-010-270; and 055-400-230. <br /> <br />2. "Development" means any use of Cargill Lands for other than the following: <br />(a) agriculture; (b) extraction of chemicals from sea water by natural evaporation and <br />extTaction of oyster shells or other deposits from San Francisco Bay; (c) public parks and <br />public recreation areas or facilities; (d) restored wetlands; and (e) uses defined as <br />accessory or conditional to the Tidal Plain zoning district set forth in the Redwood City <br />Zoning Code as of July 1, 2008. <br /> <br />3.' "Legislative action" mefuiS any amendment to the City's General Plan, Zoning <br />Code or Zoning Map, any approval of a development agreement or precise plan, or any <br />other act that is legislative in nature. <br /> <br />c. Implementation <br /> <br />1. City Council is authorized to adopt any ordinance, resolution, mle or regulation it <br />deems appropriate to facilitate implementation of this Charter Amendment. <br /> <br />2. Nothing in this Charter Amendment shall preclude the City Council from <br />combining on the same ballot or in the same ballot question multiple City Council actions <br />concerning the same development, where doing so is otherwise pennissible under State <br />law. <br /> <br />3. Under this Charter Amendment, a development project must be approved by the <br />voters only once. Once the voters have approved a legislative act permitting <br />development of Cargill Lands, subsequent actions consistent with and implementing that <br />legislative act are not required to be approved by the voters. <br /> <br />2 <br />
