<br />7A <br />Attachment A-2 Page 10 <br /> <br />C. Implementation <br /> <br />1. City Council is authorized to adopt any ordinance, resolution, rule or regulation it <br />deems appropriate to facilitate implementation of this Charter Amendment. <br /> <br />2. Nothing in this Charter Amendment shall preclude the City Council from <br />combining on the same ballot or in the same ballot question multiple City Council actions <br />conceming the same development, where doing so is otherwise permissible under State <br />law. <br /> <br />3. Under this Charter Amendment, a development project must be approved by the <br />voters only once. Once the voters have approved a legislative act permitting <br />development of Cargill Lands, subsequent actions consistent with that legislative act are <br />not required to be approved by the voters. <br /> <br />4. Nothing in this Charter Amendment is intended to diminish or otherwise alter the <br />requirement of the California Environmental Quality Act ("CEQA") applicable to any act <br />of the City of Redwood City to approve a project prior to submission to the voters for <br />ratification. City Council shall submit to the voters a legislative act approving or <br />pennitting development on Cargill Lands only after City Council has fullv complied <br />with CEQA. <br /> <br />D. Exceptions from Voter Ratification Requirement <br /> <br />1. The voter ratification requirement shall not apply to any actions necessarv to <br />prevent or mitieate an emereency or the effects of an emereencv. For purposes of <br />this subsection. "emereencv" means a sudden or unexpected occurrence. involvine a <br />clear and imminent daneer. demandine immediate action to prevent or mitieate loss <br />of. or damaee to. life. health. property. 01' essential public services. "Emereencv" <br />includes such occurrences as fire. flood. earthquake. or other soil or eeoloeic <br />movements. as well as such occurrences as riot. accident. or sabotaf!e. <br /> <br />2. The voter ratification requirement shall not be interpreted to require voter <br />approval of any amendment or action that, under State or Federal law, cannot be subject <br />to voter approval. <br /> <br />3. City Council may, without voter ratification, approve development of the Cargill <br />Lands ifit (1) makes a finding that the voter ratification requirement would constitute an <br />unconstitutional taking, and (2) allows development of Cargill Lands only to the extent <br />necessary to avoid the unconstitutional taking. <br /> <br />4. The voter ratification shall not applv to anv development for which a <br />landowner has obtained. as of the effective date of this Charter Amendment. a <br />vested rieht pursuant to State law. <br /> <br />3 <br />
