Code Section 27383 <br /> <br />DECLARATION OF AFFORDABILlTY COVENANTS <br /> <br />THIS DECLARATION OF AFFORDABILlTY COVENANTS (this <br />"Declaration") is made on , 2008, by SAN MATEO COUNTY <br />COMMUNITY COLLEGE DISTRICT ("Declarant") with respect to certain property <br />located at 4200 Farm Hill Road in the City of Redwood City, County of San Mateo. <br />California. as more fully described in the legal description and map that comprise Exhibit <br />"A" attached hereto and incorporated herein by this reference (the "Property"). <br /> <br />WHEREAS. Declarant is the fee simple owner of the Property; and <br /> <br />WHEREAS, Declarant intends to develop the Property by constructing a <br />faculty/staff rental housing project consisting of approximately sixty (60) housing units <br />(the "Project"); and <br /> <br />WHEREAS, during its meeting of July 1, 2008, the Planning Commission <br />for the City of Redwood City approved a Planned Development Permit for the Project, <br />subject to certain Conditions of Approval (the "Conditions of Approval"); and <br /> <br />WHEREAS, in accordance with the Conditions of Approval, Declarant <br />desires to maintain a minimum of nine (9) of the housing units as affordable housing <br />units; and <br /> <br />WHEREAS, Declarant desires this Declaration to serve as the instrument <br />to impose said covenants. <br /> <br />NOW THEREFORE, Declarant declares that the Property described above <br />is held and will be held, transferred, encumbered, used, sold, conveyed, leased and <br />occupied subject to the covenants, restrictions and limitations set forth in this <br />Declaration.
