<br />8A <br />Page 7 <br /> <br />year immediately preceding such lessee's initial occupancy in the Project or, if a lesse~ <br />occupying an Affordable Unit certifies that he or she did not file or did not retain a copy of <br />such tax return, other satisfactory evidence of income for such year, such, as wage <br />statements or employer records. <br /> <br />(c) Annually, Declarant and its successors shall have and make <br />available for the City to review copies of said executed Income Verification and <br />Information Forms with respect to each lessee occupying an Affordlilble Unit along with a <br />summary for the applicable year signed by Declarant or its successor, certifying <br />compliance with the provisions of this Declaration under penalty of perjury. <br /> <br />(d) To certify the compliance of Declarant or its successor with <br />these provisions, the City shall have a right to inspect the books and records pertaining <br />to such matters of the then owner( s) or operator( s) of the Property. <br /> <br />6. OccuDancv Report. Annually on July 15th of every year this <br />Declaration is in effect, Declarant shall submit an Occupancy Report. The form of the <br />Occupancy Report shall be in the discretion of Declarant, so long as the Occupancy <br />Report contains, at a minimum, the following items: <br /> <br />i) Total number of units of the Project that are occupied; <br />ii) Total number of units of the Project that are vacant; <br />iii) Total number of units that are occupied by persons or <br />households earning 100% of the AMI; and <br />iv) Total number of units that are occupied by persons or <br />households earning 80% of the AMI. <br /> <br />7. Nondiscrimination and Nonseareaation ReQuirements. <br /> <br />(a) Obliaation to Refrain from Discrimination. There shall be no <br />discrimination against or segregation of any person, or group of persons, on account of <br />any basis listed in subdivision (a) or (d) of Section 12955 of the Government Code, as <br />those bases are defined in Sections 12926, 12926.1, subdivision (m) and paragraph (1) <br />of subdivision (p) of Section 12955, and Section 12955.2 of the Government Code, or on <br />the basis of domestic partnership status or arrangement, in the sale, lease, sublease, <br />transfer, use, occupancy, tenure or enjoyment of the Property; nor shall Declarant, itself <br />or any person claiming under or through it, establish or permit any such practice or <br />practices of discrimination or segregation with reference to the selection, location, <br />number, use or occupancy of tenants, lessees, subtenants, sublessee or vendees of the <br />Property. This covenant shall remain in effect without limitation as to time. <br /> <br />Notwithstanding the immediately preceding paragraph, with <br />respect to familial status, the immediately preceding paragraph shall not be construed to <br /> <br />ATTY/AGRI2008.053 <br />080408 <br /> <br />4 <br />
