<br />6.18 <br />Page 15 <br /> <br />and no conditions, reservations or exceptions stated herein shall alter or affect the <br />terms of the bid as stated in the bid form. <br /> <br />9. BID PRICE: Bids will be compared on the basis of total net delivered price to <br />Redwood City unless otherwise stated in this bid document subject to the provisions <br />of Paragraph 5 above. The total net delivered price Redwood City shall include all <br />applicable taxes, transportation, and costs of incidentals and accessories, complete. <br /> <br />10. ROYALTIES AND PATENTS: The successful bidder shall pay all royalties and <br />patent fees. He shall defend all suits and claims for infringements of any patent <br />rights and shall save the City of Redwood City harmless from loss on account <br />thereof. <br /> <br />11. PAYMENT: Payment will be made by the City to the bidder within thirty (30) days <br />following acceptance of the bidder's performance by the City of Redwood City <br />unless otherwise stated in this bid document. <br /> <br />12. PENALTIES AND TERMINATION OF BID: In the event the successful bidder <br />refuses to deliver or provide the goods, wares, apparatus, material or services, in <br />the manner and within the time(s) specified, or fails or refuses to comply with any <br />requirements ofthis bid document, the City of Redwood City may elect to take all or <br />any of the following actions: <br /> <br />(a) City may serve notice in writing upon the bidder of its intention to cancel its <br />contract with bidder and purchase said goods, wares, apparatus, material or <br />services from another source. Unless within ten (10) days after mailing of <br />such notice the successful bidder shall make complete delivery and/or <br />comply with all requirements of this bid document, the City may without <br />further notice cancel the contract. In the event of such cancellation if the <br />purchase is thereafter made from an alternative source at a price higher than <br />the price contained in the original bid, the successful bidder shall be liable to <br />the City for the amount of the difference between the purchase price and the <br />original bid contract price. <br /> <br />(b) In the event any provision ofthe contract or this bid document is violated and <br />the successful bidder fails or refuses to comply after notice as hereinabove <br />specified, the successful bidder shall be declared to be an irresponsible <br />bidder in which case no contract shall be awarded to him by the City for a <br />period of at least three (3) years from the date of such failure and then only <br />after evidence satisfactory to the City of Redwood City is submitted to <br />substantiate his claim of responsibility. <br /> <br />13. CONTRACTOR LICENSING: Contractor licensing does not apply on this project. <br /> <br />14. CALIFORNIA STATE SALES TAX: Supplier shall state whether California <br />Sales/Use tax is included (at the bottom of Page 9 on the proposal form). <br /> <br />13 <br />
