<br />Of" <br /> <br />'" <br /> <br />No Waiver <br />9. <br /> <br />The failure of either party to execute or enforce a right or to require performance by the other <br />party of any part of this Agreement shall not affect the full right to exercise such right or to require <br />such performance at any time thereafter, nor shall the waiver by either party of a breach of any <br />provision of this Agreement constitute a waiver of any later breach of the same of any other <br />proVIsIOn. <br /> <br />Interpretation <br />10. <br /> <br />This Agreement shall be interpreted in accordance with the plain meaning of its terms and not <br />strictly for or against any of the parties hereto. <br /> <br />Severance <br />11. <br /> <br />If any provision of any Paragraph of this Agreement (or any Paragraph in its entirely) is held or <br />found to be invalid or unlawful, then the provision or Paragraph found to be unlawful shall be <br />deemed void as of the date of the execution of this Agreement and shall be severed and deleted <br />from this Agreement. All remaining provisions and Paragraphs shall remain and continue in full <br />force and effect. <br /> <br />Survival <br />12. <br /> <br />All unfulfilled obligations of either party pursuant to this Agreement shall survive any termination <br />or expiration of iliis Agreement <br /> <br />Paral!:raph Headinl!:s <br />13. The Paragraph headings contained herein are for purposes of reference and convenience only and <br />shall not be used or referred to in any way in construing the meaning of this Agreement, or any <br />Paragraph hereof. <br /> <br />Entire Al!:reement <br />14. This Agreement, together with all attachments and applicable advertising contract and insertion <br />order( s), sets forth the entire agreement between the parties with regard to the placement and <br />scheduling of advertising in the Mercury News.
