<br />ATTACHMENT 2 7C <br />Page 7 <br /> <br />RIEP.ORT <br /> <br />To the Honorable IfJl~lyor and City Coohe11 <br />From the City Mana.ge'r <br /> <br />March 26, 2007 <br /> <br />Subject <br />Amendment to Chapter 3 of the Municipal Code regulating Advertising and Signs. <br /> <br />Recommendation <br />1. By Motion: Make the following findings: <br />· The 1999 inventory of non--conforming signs in Redwood City has been updated <br />and is confirmed as adequate and complete for sign amortization purposes. <br />· The proposed amendments confonn to the California Environmental Quality Act. <br />· The amended ordinance will make Redwood City's sign ordinance consistent <br />with current case law related to sign age; <br />2. Rescind the existing sign ordinance (Chapter 3, Articles /I "Signs" and III "Motor <br />Vehicle Fuel Price Signs," of the Municipal Code); and <br />3. Introduce the proposed new sign ordinance (Chapter 3, Articles II "Signs" and III <br />"Signs on Public Property," of the Municipal Code) (Attachment 1). <br /> <br />Background <br />Redwood City last amended its sign ordinance in 1999. Since that time, a significant <br />number of State and Federal legislative changes have affected how signs are regulated -- <br />for the most part, these changes involve First Amendment rights. Staff has incorporated <br />these changes to the proposed draft Sign Ordinance (Attachment 1). Current City <br />standards such as the number, placement, size and maximum area calculations for signs <br />remain unchanged. <br /> <br />The proposed ordinance changes include the following: <br /> <br />1. Signs on private property are regulated separately from signs located on public <br />property; <br />2. Content-based regulations have been eliminated, "however, the courts consider <br />the on-site I off-site distinction to be based on location, not message content." <br />3. The amortization periods for non-conforming signs (Le. a time period allocated <br />for the abatement of signs that were legally permitted in the past but that no <br />longer conform to current signage regulations) have been extended to conform <br />to State standards; <br /> <br />1 <br />
