<br />11/10/2008 <br /> <br />ARTICLE III - PATROL BOAT OWNERSHIP <br /> <br />The DEPARTMENT shall be the legal owner of the PATROL BOAT and the <br /> <br />GRANTEE shall be the registered owner. The GRANTEE shall not assign, <br /> <br />mortgage, hypothecate or transfer its interest in the PATROL BOAT <br /> <br />without the prior written approval of the DEPARTMENT. <br /> <br />ARTICLE IV - OPERATION AND MAINTENANCE OF PATROL BOAT <br /> <br />A. The GRANTEE shall use the PATROL BOAT for the purposes of <br /> <br />promoting boating safety and law enforcement and shall keep the <br /> <br />PATROL BOAT available for search and rescue operations per mutual <br /> <br />aide requests from neighboring allied agencies and existing <br /> <br />agreements with the United States Coast Guard. <br /> <br />B. The GRANTEE shall be responsible for the costs of operating and <br /> <br />maintaining the PATROL BOAT; the DEPARTMENT shall not be liable <br /> <br />for such costs. <br /> <br />C. The GRANTEE shall maintain the PATROL BOAT in good repair. <br /> <br />D. The GRANTEE, at its own expense, agrees to replace the PATROL BOAT <br /> <br />if it is destroyed or rendered useless prior to the expiration of <br /> <br />this CONTRACT. <br /> <br />E. Representatives, agents or employees of the GRANTEE in the <br /> <br />performance of this CONTRACT shall act in independent capacity and <br /> <br />not as officers, employees or agents of the DEPARTMENT. <br /> <br />F. The GRANTEE shall keep complete and accurate records of all <br /> <br />expenditures pertaining to the purchase of additional equipment <br /> <br />and the operation and maintenance of the PATROL BOAT; such records <br /> <br />shall be available and open to the DEPARTMENT at all reasonable <br />14906 <br />2 MUFF 706 <br />
