o o 4/21/81 HOLD HARMLESS AND RELEASE AGREEMENT CITY OF REDWOOD CITY (hereinafter "Contracting Agency"), in consideration of city of San Mateo (hereinafter "City") conducting an 82-hour motorcycle training course for peace officers of Contract- ~//slg / ft (..!~~ I g I -i- ing Agency from g-/~ J 8/ to ~'/ J c/ / g / at the East parking ( , I lot of the San Mateo County Fair Association, agrees as follows: 1. Contracting Agency will hold harmless, indemnify, and defend the City, its officers and employees from any and all claims, actions.. causes of action, demands, rights, costs, expenses, and compensation for loss of liability arising out of bodily injuries or death, and/or for damage to property, resulting from or alleged to have resulted from Contracting Agency's participation in the above- mentioned course. 2. Contracting Agency will reimburse city for any damage suffered by City, and also reimburse the San Mateo County Fair Association, California Jockey Club (dba Bay Meadows Race Track), and the County of San Mateo for any damage sustained.by any of them, resulting from or alleged to have resulted from Contracting Agency's participation in the abovementioned course. 3. Contracting Agency ~eleases, acquits, and forever discharges city, its officers and employees, from any and all liability to contracting Agency arising from City's conducting said course, and waives the benefit. of Civil Code S1542 which reads: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have. materially affected his settlement with the debtor."
