BACKGROUND The existing restroom facility in Lower Stulsaft Park was installed 40 years ago. It is at the end of its useful life and requires replacing. This project will create a new facility for all park patrons and will comply with the accessibility provisions of the American with Disabilities Act. Six (6) bids were received at the bid opening on December 17, 2008 and are summarized below. Arthulia Sanchez, Inc. Recommended Bidder: McNabb Construction, Inc. Substantiation: McNabb Construction, Inc. is the lowest responsive and responsible bidder The City Attorney has determined that defects contained in the lowest bid received of $140,950.00 from Restroom Facilities, Ltd. are substantive and may not be waived. Restroom Facilities, Ltd. failed to provide an amount for each bid item as specified. As a result, Restroom Facilities bid is considered non-responsive and staff recommends award of the contract for this project to McNabb Construction, Inc. as the lowest responsive and responsible bidder. The bid received from McNabb Construction, Inc. is 3% higher than the engineer's estimate of $140,000.00.
