01/12/2009 <br />3. Automobile means a land motor vehicle, trailer, or semi- trailer. <br />4. Bodily injury means bodily injury, sickness, disease, or emotional distress sustained by <br />a person, including death resulting from any of these at any time. Bodily injury includes <br />damages claimed by any person or organization for care, loss of services, or death <br />resulting at any time from the bodily injury. <br />5. Covered Indemnity Contract means that part of any contract or agreement pertaining to <br />the covered party's routine governmental operations under which the covered party <br />assumes the tort liability of another party to pay for bodily injury or property damage <br />to a thud person or organization. This definition applies only to tort liability arising out <br />of an occurrence to which this MOC applies. Tort liability means a liability that would <br />be imposed by law in the absence of any contract or agreement. <br />b. Covered party means: <br />(a) The Participant, including any and all councils, commissions, agencies, districts, <br />authorities, boards, including the governing board or similar entities corning under <br />such Participant's direction or control or for which such Participant's board <br />members sit as the governing body. Covered party includes departments and. <br />constituent agencies of the Participant, except an airport or hospital board or <br />commission, regardless of how such body is denominated. <br />(b) Persons who are past or present elected or appointed officials, employees, or <br />volunteers of the covered party, whether or not compensated, while acting for or <br />on behalf of the covered party, including while acting on outside boards at the <br />direction of the covered party, except any airport or hospital board or <br />commission, regardless of how such body is denominated, or any other joint <br />powers authority, or any separate agency or entity, created by a joint powers <br />agreement, subject to the provisions of subparagraph (e), provided., however, that <br />an airport board or commission may be added to this MOC by endorsement on <br />approval of the Board. <br />(c) Any person or entity identified as a covered party, holding a certificate of <br />coverage duly issued by the Authority, for occurrences during the coverage <br />period identified in the certificate of coverage; if a particular activity is identified <br />in the certificate of coverage, the person or entity is a covered party only for <br />occurrences arising out of the described activity. <br />(d) Any officer or director of the Authority, and the staff and employees of the <br />Administrator thereof while in the course and scope of their duties for the <br />Authority, with respect to public officials errors and omissions coverage. <br />(e) Covered party does not include any person, organization, trust, or estate or any <br />other entity for any risk, claim, or loss which is incurred or occurs under any other <br />D� <br />J:I BCJPIA1 Admin\Documents%Governing\MOC's and MI 20091I.iability /Liability MOC 2008 -2009 FINAL 050808.doe <br />14919 <br />MUFF #505 <br />
