<br />6.18 <br />Page 3 <br /> <br />AGREEMENT <br /> <br />LEASE AGREEMENT - COMMUNICATION SITE <br /> <br />(1000 RADIO ROAD) <br /> <br />THIS LEASE ("Lease"), dated '"'Dff'l:!.!A.\ht,Jj l)..'l$ , 2008 is made by and between <br /> <br />the CITY OF REDWOOD CITY, a municipal corporation of the State of Califomia <br /> <br />("Lessor") and Omnipoint Communications, Ine" a Delaware corporationt d/b/a T- <br /> <br />Mobile ("Lessee"). <br /> <br />RECIT ALS <br /> <br />WHEREAS, Lessor is the owner of certain property situated ill San Mateo <br /> <br />County, State of California, commonly known as 1000 Radio Road (APN 095-443-010), <br /> <br />and described in Exhibit "A", attached hereto and incorporated by reference (the HSite")~ <br /> <br />and <br /> <br />WHEREAS, the Site is improved by a electric transmission tower owned, <br /> <br />maintained and operated by Pacific Gas and Electric Company ("PG&E"); and <br /> <br />Whereas, a portion of the Site is used by PG&E pursuant to an easement <br /> <br />agreement with the City of Redwood City; and <br /> <br />\VHEREAS, Lessee is a corporation organized under the laws of the State of <br /> <br />Delaware whose principal business is to provide mobile radio/wireless communications <br /> <br />services ~ and <br /> <br />WHEREAS, Lessee desires to use a portion of the Site and Lessor is willing to <br /> <br />permit Lessee to lease a portion of the Site in accordance with the terms, conditions and <br /> <br />covenants of this Lease. <br /> <br />ATTY/AGRJ200S.(>44 Le..a~e AgreememT-Mobile <br />121908 <br />
