<br />6.18 <br />Page 6 <br /> <br />4. USE. <br /> <br />4.01 Pennitted Uses. <br /> <br />(a) Lessee shall use the Leased Premises as one of Lessee's mobile <br /> <br />radio/telephone base stations (a "Base Station") comprising Lessee's system (the <br /> <br />"System") for furnishing the mobile radio/telephone service to the public. A Base Station <br /> <br />is a site at which radio and telephone equipment is installed and used to send, amplify <br /> <br />and receive radio signals to and from mobile radios and telephones and to connect those <br /> <br />signals to telephone facilities either directly, by means of cables, or indirectly, by means <br /> <br />of microwave transmitting facilities (including microwave antermas) or other wireless <br /> <br />equipment located at the Base Station. Lessee shaH not use the Leased Premises for any <br /> <br />other purposes without the written consent of Lessor. <br /> <br />(b) The installation of any of Lessees facilities. equipment and <br /> <br />improvements shall be subject to the reviews, approvals and requirements set forth in <br /> <br />Paragraph 5.05. Lessee shall be solely responsible for any and all costs associated with <br /> <br />the installation, improvement, repair, maintenance and use of Lessee's improvements, <br /> <br />equipment and facilities on the Leased Premises. <br /> <br />(c) Lessor grants Lessee reasonable vehicular and foot access to and <br /> <br />around the Leased Premises without notice to Lessor. Said access shall be available <br /> <br />twenty~four (24) hours a day, seven (7) days a week (the "Access Areas"). <br /> <br />4.02 Prohibited Uses. Lessee shall not use the Leased Premises for any <br /> <br />purpose not expressly permitted hereunder. Lessee shall not (a) create, cause, maintain or <br /> <br />permit any nuisance in, on or about the Leased Premises or permit or suffer the Leased <br /> <br />Premises to be used for any unlawful or immoral purpose, or (b) do or permit to be done <br /> <br />A TIYJAGRI2008.044 Lease Agreemenl T-Mobik. <br />121908 <br /> <br />4 <br />
