The total amount of improvements completed is <br />estimated at $21,144,413. <br />ANALYSIS <br />The developer, Board of Trustees of the Leland Stanford Junior University, has completed the construction <br />of the majority of the improvements in accordance with the Agreement, the plans and specifications, the <br />conditions of approval, and to the satisfaction of the City's Engineering Division. During the process of <br />undergrounding the overhead utilities along the frontage of the project's central energy facility on <br />Douglas Ave., only a portion of the overhead utilities were undergrounded. As there is an upcoming <br />Stanford Health Care project that is presently undergoing City entitlement review that will include the <br />undergrounding additional overhead utilities, it was determined that it would be more appropriate to <br />have that entity underground the remaining facilities. Stanford Health Care will post bonds in the amount <br />of $713,333.56 as required by the Improvement Agreement, and they anticipate the completion of these <br />improvements by the beginning of 2022. <br />The developer provided a faithful performance bond and a labor and material bond, each in the amount <br />of $21,144,413 that may now be released in accordance with the timing described in the Improvement <br />Agreement. <br />The Developer is responsible for the maintenance of the frontage improvements including sidewalk, curb <br />and gutter, street trees, irrigation, and pedestrian scale street lighting through the Landscape <br />Maintenance Agreement. The Developer is also responsible for the maintenance of on-site stormwater <br />treatment measures through the Stormwater Treatment Measures Maintenance Agreement. <br />FISCAL IMPACT <br />There is no fiscal impact to the City as a result of this action. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />The City certified the project EIR on September 13, 2013 with an associated Mitigation Monitoring and <br />Reporting Program (MMRP). Staff and environmental consultant David J.
