Restoration of existing landscape, irrigation, and hardscape improvements ANALYSIS The improvements outlined by the project plans and specifications have been successfully completed, therefore staff recommends acceptance of the project. However, the final change order for the intersection reconstruction work, as described in the staff report on November 25, 2019, has not been executed because the final contract amount was disputed. Additionally, the City received two stop payment notices and notice of a lawsuit based on the alleged failure of Seton to pay subcontractors on the project. The City is working with the subcontractors and Seton's bond surety to ensure all subcontractor claims are paid, and has reached a tentative agreement with Seton on the final contract amount. The City can proceed with project acceptance while negotiation of the final project cost and the subcontractors' claims are pending. Acceptance will allow the release of the undisputed retention, and the disputed retention will be withheld until the disputes are resolved. FISCAL IMPACT Funding for this project was previously approved through the City's FY 2017-2018 Capital Improvement Program, developer contribution (from the development project located at 601 Marshall Street), and supplemental funds from the Active Transportation Corridor Program approved by the City Council on November 25, 2019. ENVIRONMENTAL REVIEW This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably foreseeable indirect physical change in the environment. On March 11, 2019, the City Council determined that the Marshall Street Intersection Improvements at Jefferson Avenue and Middlefield Road Project meets the California Environmental Quality Act (CEQA) exemption criteria as set forth in Section 15301, "Existing Facilities". PUBLIC NOTICE Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 hours prior to the meeting.
