<br />... <br /> <br />2/11/02 <br /> <br />..COPJ. <br /> <br />RESOLUTION NO. 1 441 5 <br /> <br />RESOLUTION VACATING A PORTION OF A 20 FOOT WIDE <br />UNDERGROUND PUBLIC UTILITY EASEMENT AT 3636 & 3642 <br />HAVEN AVENUE (LOT NO.1, PARCEL MAP 2001-3) IN THE CITY <br />OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, <br />CHAPTER 4, ARTICLE 1, (SUBSECTION 8333(a)), CALIFORNIA <br />STREETS AND HIGHWAYS CODe OF THE STATE OF <br />CALIFORNIA <br /> <br />WHEREAS, The owner of 3636 & 3642 Haven Avenue (Lot No.1, Parcel <br /> <br />Map 3001-3), Carrera PRB Company, a limited partnership, has requested that <br /> <br />the City terminate the public right on the properties for the purpose of installing <br /> <br />and maintaining public utilities, and <br /> <br />WHEREAS, The 20 foot wide underground public utility easement <br /> <br />proposed to be vacated is more particularly described in Exhibit "A" and depicted <br /> <br />in Exhibit "B" hereof, which Exhibits are attached hereto and by this reference <br /> <br />incorporated herein, and <br /> <br />WHEREAS, Section 8333(a) of the Streets and Highways Code of the <br /> <br />State of California allows a City to summarily vacate a public service easement if <br /> <br />the easement "has not been used for the purpose for which it was dedicated or <br /> <br />acquired for five consecutive years immediately preceding the proposed <br /> <br />vacation," and <br /> <br />WHEREAS, The City and other utility companies do not have any utilities <br /> <br />in this 20-foot easement, nor have any interest in preserving the easement for <br /> <br />future public use. <br /> <br />- <br />F:A TTY/RESO/Reso.1276 <br />020102 ' <br /> <br />'~ <br /> <br />II11I11111111111111I111111I1111111111111111111111111111 <br /> <br />2002-030417 <br />02/19/2002 03:06P <br />R1 Page: 2 of 6 <br />
