6.1 B Page 8 advertising for bids. To allow Railroad to incorporate them in its plans and specifications, City will provide IPB with its forms of Construction Permit for the project prior to bid. City agrees to issue Construction Permit to Contractor after contract award in the form provided prior to bid. The form of Construction Permit will contain reasonable conditions and restrictions including specifying normal work hours Monday-Friday 8AM- 8 PM, but allowing night and weekend work for railroad-related work that cannot be safely or practically done at other times. City will issue a Haul Route Pennit, ifrequired, for routes along City streets between work areas and State highways. The IPB will provide for construction staging and traffic control in its final bid documents. 7. Quality of Work. All work contemplated in this Agreement shall be performed in a good and worker-like manner in accordance with the plans and specifications to the satisfaction of the parties, and each portion shall be prolllptly cOlnnlenced by the party obligated to do the same and thereafter diligently prosecuted to completion in its logical order and sequence. 8. Maintenance. Upon completion of construction, the parties shall be responsible to maintain the following Improvenlents (except, in the case of the City, as otherwise set forth by City code, ordinance, regulation or statute): a. City shall maintain and maintain at its expense (including electric power for lighting): i. City streets and pavement up to the crossing panels (the ground markers that demarcate the Railroad right-of-way) but not between the crossing panels, street curbs, gutters, medians, sidewalks within its easement area, as well as pavement markings and 6
