ORDINANCE NO. 639
<br /> RELATING TO AND REGULATING THE CONSTRUCTION, RECON-
<br /> STRUCTION AND REPAIR OF WALKWAYS, DRIVEWAYS, CURBS
<br /> AND PARKING STRIPS ON THE PUBLIC STRFRTS, ALLEYS AND
<br /> WAYS IN THE CITY OF REDWOOD CITY, AND REPEALING SEC-
<br /> TION 6 OF ARTICLE I OF ORDINANCE NO. 333 AND REPEAL-
<br /> ING ORDINANCE NO. 402 OF THE CITY OF REDWOOD CITY
<br /> The Council of Redwood City do ordain as follows:
<br /> ARTICLE I
<br /> SECTION 1. For the purpose of this ordinance, unless it is plainly
<br /> evident from the context thereof that a different meaning is intended,
<br /> certain terms used herein are defined as follows:
<br /> ( a) "Walkway" shall include a park or parking strip maintained in
<br /> the area between the property line and the curb line and also includes a
<br /> driveway, curbing, bulkhead, retaining wall, sidewalk or other works for
<br /> the protection of any sidewalk or walkway or any such park or parking
<br /> strip located in any public street, way or thoroughfare within the city.
<br /> (b) "Repair" shall include the construction, reconstruction, re-
<br /> pair, replacement, restoration or improvement of any walkway.
<br /> ( c) "Owner" shall mean any person, firm or corporation, or the
<br /> agent or representative of any person, firm or corporation, in which is
<br /> vested the title to any parcel of real property posted under this ordi-
<br /> nance.
<br /> (d) "Engineer" shall mean the City Engineer and Superintendent of
<br /> Streets..
<br /> (e) "City" shall mean the City of Redwood City.
<br /> Words in the plural include the singular and those used in the
<br /> singular include the plural.
<br /> SECTION 2. When any portion of any walkway is out of repair or in
<br /> condition to endanger persons or property, or in condition to interfere
<br /> with the public convenience in the use thereof, the Engineer, in the
<br /> manner provided, shall notify the owner or person in possession of the
<br /> property abutting or fronting on that portion of such walkway so out of
<br /> repair, to repair.
<br /> SECTION 3, The notice to repair shall describe the work to be done,
<br /> designate the materials to be used and specify the manner in which said
<br /> work shall be done, and shall be substantially in the following form:
<br /> "NOTICE TO REPAIR (walkway, sidewalk, curb, driveway, bulkhead,
<br /> retaining wall, park or parking strip) . The owner of the property des-
<br /> cribed as follows :
<br /> commonly known as _ _
<br /> is hereby ordered to repair the walkway, sidewalk, curb, driveway,
<br /> bulkhead, retaining wall, park or parking strip) in front of or abutting
<br /> said property in accordance with Specifications No._ on file in
<br /> the office of the City Engineer and Superintendent of Streets of the City
<br /> of Redwood City, and all ordinances of the City of Redwood City pertaining
<br /> thereto, within ten (10) days from the date hereof, or to appeal in writ-
<br /> ing to the legislative body of the city within said ten ( 10) days, and
<br /> show cause why said work should not be done or why the time therefor
<br /> should be extended. If the work herein indicated is not commenced within
<br /> the time fixed herein, or any extension thereof granted by said legis-
<br /> lative body, the said city engineer and superintendent of streets will
<br /> cause the work to be done, and the cost thereof, including any incidental
<br /> expenses, will be made a lien upon said property pursuant to Ordinance
<br /> No.
