<br />expiration of thirty (30) days after Lessor shall have received written notification of <br /> <br />cancellation or reduction in coverage by first class mail; <br /> <br />(ii) Providing that Contractor's insurance shall apply separately <br /> <br />to each insured against whom claim is made or suit is brought, except with respect to the <br /> <br />limits of the insurer's liability (cross-liability endorsements); <br /> <br />(iii) Naming Lessor, its Council, comnlissions, boards, <br /> <br />committees, officers, employees and agents as additional insureds; and <br /> <br />(iv) Providing that Lessee's insurance shall be primary <br /> <br />insurance relating to Lessee's negligence hereunder with respect to Lessor, its Council, <br /> <br />commissions, boards, committees, officers, employees and agents, and further providing <br /> <br />that any insurance or self-insurance maintained by Lessor for itself, its Council, <br /> <br />commissions, boards, committees, officers, employees and agents shall be in excess of <br /> <br />Lessee's insurance and shall not be contributory with it. <br /> <br />7. DAMAGE. DESTRUCTION AND TERMINATION. <br /> <br />7.01 Ri{ilit to Terminate. The Lease may be tenninated on thirty (30) days <br /> <br />prior written notice as follows: (i) by either party upon a default of the covenant or term <br /> <br />hereof by the other party, which default is not cured within thirty (30) days of mailing of <br /> <br />written notice of default, provided that the grace period for any monetary default is ten <br /> <br />(10) days from mailing of notice; or (ii) by Lessee if it cannot obtain or maintain through <br /> <br />no fault of its own any license, permit or other approval necessary for the construction <br /> <br />and operation of the Lessee's Facilities; or (iii) by Lessee if Lessee is unable to occupy <br /> <br />and utilize the Leased Premises due to an action of the Federal Communications <br /> <br />Commission, including without limitation, a take back of channels or change in <br /> <br />ATTY/AGRlZOOS,(l44 Lease Agreement T-Mobile <br />121908 <br /> <br />17 <br />
