<br />'- <br /> <br />SFo~~ L.{- <br /> <br />ORIGINAL <br /> <br />AGREEMENT <br /> <br />LEASE AGREEMENT - COMMUNICATION SITE <br /> <br />(1000 RADIO ROAD) <br />THIS LEASE ("Lease~'), dated j)e,C'JUAA. bt.1. 2. ~ , 2008 is made by and between <br /> <br />the CITY OF REDWOOD CITY, a municipal corporation of the State of Califonlia <br /> <br />("Lessor") and Omnipoint Communications, Inc., a Delaware corporation, d/b/a T- <br /> <br />Mobile ("Lessee"). <br /> <br />RECIT ALS <br /> <br />WHEREAS, Lessor is the owner of certain property situated in San Mateo <br /> <br />County, State of California, commonly known as 1000 Radio Road (APN 095-443~010), <br /> <br />and described in Exhibit "A", attached hereto and incorporated by reference (the "Site"); <br /> <br />and <br /> <br />WHEREAS, the Site is improved by a electric transmission tower owned, <br /> <br />maintained and operated by Pacific Gas and Electric Company ("PG&E"); and <br /> <br />Whereas~ a portion of the Site is used by PG&E pursuant to an easement <br /> <br />agreement with the City of Redwood City; and <br /> <br />WHEREAS, Lessee is a corporation organized under the laws of the State of <br /> <br />Delaware whose principal business is to provide mobile radio/wireless communications <br /> <br />services ~ and <br /> <br />WHEREAS, Lessee desires to use a portion of the Site and Lessor is willing to <br /> <br />permit Lessee to lease a portion of the Site in accordance with the terms, conditions and <br /> <br />covenants of this Lease. <br /> <br />ATTY/AGRJ2008Jl44 Lease Agreement T-Mobile <br />121908 <br />
