. , °� <br /> 0921GINAL <br /> AMENDMENT NO. 2 TO AGREEMENT FOR AQUATIC PLANT MANAGEMENT AND <br /> ENVIRONMENTAL ENGINEERING SERVICES <br /> (Waterworks Industries, Inc.) <br /> Th' Amendme t No. 2 is entered into and effective as of the � day of <br /> , 2012, amending the agreement dated April 6, 2009 (the <br /> "Agreeme by and between the City of Redwood City, a charter city and municipal <br /> corporation ("City"), and Waterworks Industries, Inc., ("ConsultanY') (collectively, the <br /> "Parties") for aquatic plant management and environmental engineering services at the <br /> Redwood Shores Lagoon. <br /> RECITALS <br /> A. On April 6, 2009, the Parties executed an Agreement for Aquatic Plant <br /> Management and Environmental Engineering Services, for the Redwood Shores <br /> Lagoon; and <br /> B. On May 5, 2011, the Parties executed Amendment No. 1 to extend the <br /> Agreement for one additional one-year term through March 31, 2012; and, <br /> C. The Parties desire to extend the Agreement for an additional one-year term, <br /> as provided for in the Original Agreement, pursuant to the scope of services and fee <br /> schedule set forth in Exhibit A of the original Agreement, incorporated herein by <br /> reference. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. Consultant will continue to provide those services described in Exhibit "A" <br /> of the original Agreement. <br /> 2. The Agreement is hereby extended for a period of one year, commencing <br /> April 1, 2012 and ending on March 31, 2013. <br /> 3. City will pay Consultant for all work associated with those services <br /> described in Exhibit "A" of the original Agreement, incorporated herein by this reference, <br /> in an amount not to exceed One Hundred Ninety-Eight Thousand Four Hundred and <br /> no/dollars ($198,400.00). Consultant will provide City, on a monthly basis, copies of <br /> . invoices sufficiently detailed to include hours performed, hourly rates, and related <br /> activities and costs for approval by City: <br /> 4. All other provisions of the Agreement, as may have been amended from <br /> time to time, will remain in full force and effect. <br /> 5.
