<br />88 <br />Page 109 <br /> <br /> <br /> <br />South Baysjd~ Waste Management Authority <br /> <br />In making this final recommendation of South Bay Recycling as the Facility Operator, the <br />Selection Committee wants to emphasize that the Board needs to place strict limits on changes <br />to the "current understanding" of South Bay Recycling's proposal upon which the sel action <br />decision was made. The successful negotiation of a Final Agreement between South Bay <br />Recycling and the SBWMA should include a reaffirmation of the Company's total cost <br />(operational, MRF sorting equipment, and equipment installation). Additionally, SBWMA staff <br />should be authorized to terminate negotiations with South Bay Recycling and consider <br />negotiations with Hudson Baylor Corporation should the Company retreat from the terms and <br />costs upon which the Selection Committee's selection decision was based. <br /> <br />The Selection Committee recommendation of SBR is being made to the SBWMA with the <br />intention of having the Board select SBR and to direct Staff to begin final contr.act negotiations <br />for the operation of the Shoreway facility. After the final Draft Agreement is negotiated with <br />SBR, Staff will bring this back to the Board for consideration. Ratification will be required by a <br />2/3 vote of the SBWMA Board. It is anticipated that action will be taken on the Facility <br />Operations contractor selection at the April meeting of the SBWMA Board of Directors. <br /> <br />In addition, the Final Agreement for the Facility Operations will need two-third's Member <br />Agencies' approval.
