<br />88 <br />Page 122 <br /> <br />APPENDIX A <br /> <br />Answers from South Bay Recycling dated February 13, 2009 <br />Questions and Requests for Additional Information from SBWMA <br /> <br />FULL EXPLANATION OF COST WORKSHEET ADJUSTMENTS <br /> <br />An excel spreadsheet was provided to SBWMA which clarifies all areas where cost <br />adjustments were made. SBR sent the spreadsheets earlier this morning with two <br />worksheets (detail and explanation) which itemize the cost adjustments in a manner <br />consistent with discussions which took place in July and August 2008. <br /> <br />UPDATE: LABOR ISSUES <br /> <br />Regarding the Teamsters #350, there have been no recent discussions or communications. <br />The status remains that SBR signed a MOU (Appendix D of Facility Operations <br />Contractor Selection Report dated January 15, 2009) with language consistent with the <br />RFP and CBA ensuring no change to working conditions or compensation. This issue <br />has been politicized and misconstrued. If the Teamsters expand their CBA representation <br />to include MRF Sorters, then the annual operating cost to SBWMA will increase by over <br />$1 million dollars per year. SBR does not object to the planned expansion, but we do not <br />think it is appropriate to make agreements which move beyond RFP and CBA <br />requirements during the selection process. <br /> <br />Regarding the Teamsters #396, discussions are ongoing and we will provide SBWMA <br />with updated information during the week of February 16th, 2009. <br /> <br />Regarding the San Mateo County Central Labor Commission, there have been no <br />discussions or communications subsequent to them advising SBR that no meetings can <br />take place until the Teamsters #350 issues are resolved. <br /> <br />UPDATE: CITY OF LA PERMIT ISSUES <br /> <br />The site continues to legally operate under an Interim Operating Agreement. We will <br />keep SBWMA advised of any developments. <br /> <br />UPDATE: SELF HA UL DIVERSION GUARANTEE <br /> <br />SBR will make commitments to self haul diversion, and is in the process of determining <br />what these levels will be. We will provide SBWMA with this information during the <br />week of February 16th, 2009. If it is possible to receive the 2008 tonnage information for <br />current activities at the site, then that would be helpful in creating a diversion guarantee. <br />
