SBR requests SBWMA's written approval for SBR to sell all <br />recyclable materials to Potential Industries (PI). <br /> <br />SBR will comply with Section 5.16 of the agreement to ensure that material is sold at <br />competitive market pricing consistent with pricing that other MRF's are receiving in the <br />9 county Bay area. <br /> <br />SBR will be responsible for Agreement Liquidated Damages per Attachment 10, except <br />for provisions of the off take agreement which states 'l2 the ONP and Y2 the ace will be <br />sold at prevailing average export market prices, and price for the balance of material will <br />be not less than $70.00 FOB San Carlos for ONP and $80.00 FOB San Carlos for ace. <br />SBR will comply with Attachment 3 Section 6.1 to achieve at a minimum the Index <br />Prices calculated by SBWMA' s commercially reasonable field survey of local (ie. in the <br />9 county Bay area) purchasers of commodities. <br />
