<br /> <br />AFL.CIO <br /> <br />February 12, 2009 <br /> <br />The Honorable Jerry Deal <br />Burlingame City Council <br />1226 Paloma Avenue <br />Burlingame, CA 94010 <br /> <br />Dear Council Member Deal, <br /> <br />The San Mateo County Central Labur COlln-cil is extremely dismayed at the SOllth- <br />Bay Waste Management Authority's recommendation to select South Bay Recycling <br />as tile facility operator for the SBWMA Shoreway Facility. SBR bas a shameful <br />enVh"Ollmental record and an appalling histOl"Y of contentious labor practices. Of <br />particular concern is SBR's refusal to sign the Teamster's MOTI, which was signed <br />by other companies that bid on tile RFP. In addition; the president of the Board of <br />Supervisors, Mark Church, was assured that tbey would be doing so. As of this <br />writing, they still bave not made good on that promise. If they can't be trusted to <br />follow through on their commitment to the San Mateo County Board of <br />S'lipervisors, how can they be tl;usted to comply witli. all the stipulations in the <br />Reqli~t for Proposals? How can they be trusted to serve our community? . <br /> <br />SBR has not just violated labor's trust, tbey have multiple violations in their <br />business practices that are unacceptable for an organization tasked with making <br />dramatic, immediate improvements to our environment. It has received two cease <br />and desist orders from the California Integrated Waste Management Board, has <br />been fined by the Air Resource Board, and bas numerous citations from several' <br />jurisdictions where they provide service. <br /> <br />We are urging you to direct your appointee at the SBWMA to WITHDRAW the <br />recommendation of SBR as the facility operator and tbat you reject any further <br />efforts to promote them. A company with complete disregard for the environmental <br />health of residents and workers should not be rewarded with a lucrative contract. <br /> <br />The Labor Council asks you to consider replicating the action taken by the San <br />Mateo County Board of Supervisors during a January 27 meeting. The <br />Subcommittee on Finance and Operations, with President Church and Supervisor <br />Gordon voting, expressed serious concerns regarding the SBWMA staff <br />recommendation to select SBR. Supervisors cautioned if a contract with SBR moves <br />fo~ward, .they would not be" in favor of granting the neces.sary bonding authority <br />requested by the SBWMA. (Tbey instead recommended Hudson Baylor . <br />Corporation for the contract.) <br />
