LABOR AGREEMENT <br /> LABOR CONNECTION <br /> <br />Labor Connection ("LC") agrees to supply unlicensed construction workers ("LC <br />Workers") to the City of Redwood City, a municipal corporation ("City"), effective as of <br />the date of this Agreement on the following terms and conditions. <br />ENGAGEMENT: LC Workers are the employees of LC, and LC retains all fight and <br />authority to recruit, hire, employ, assign and reassign, promote, discipline and terminate <br />LC workers. LC is an Equal Opportunity employer. LC will use its sole discretion to <br />select and assign LC Workers with skills and experience levels appropriate to City's <br />needs. LC Workers are covered by Worker's Compensation and General Liability <br />insurance, and LC is responsible for all federal and state payroll taxes and withholding <br />and other applicable fringe benefits. LC will provide City with a Certificate of Workers <br />Compensation insurance. LC will use its best efforts to supply LC Workers to City upon <br />City's oral request from time to time. There shall be a four hour minimum charge on each <br />LC Worker provided and an eight hour minimum charge on all skilled workers. LC <br />Workers working 120 hours or more for City may be assumed by City with no additional <br /> <br /> LIMITED GUARANTEE: If City is dissatisfied with any LC Worker for any reason, LC <br /> will replace such unsatisfactory LC Worker within the fa'st five hours of assignment. <br /> City shall not be invoiced for the hours worked by such unsafsfactory LC Worker when <br /> LC is notified within the first five hours of assignment. <br /> <br /> TERMS: City will be invoiced weekly based on an hourly rate (the "Billing Rate") for <br /> each hour a LC Worker is engaged in construction work on City's jobsite. The Billing <br /> Rate and any applicable minimums and overtime rates shall be specified by LC to City on <br /> a separate Schedule of Fees attached hereto. Invoices are due and payable within thirty <br /> days of ~nvoice date. Monthly late charges at the rate of one and one-half percent per <br /> month will be added to the outstanding balance on all invoices not paid in full when due. <br /> CITY'S RESPONSIBILITIES: City shall be solely responsible for directing the LC <br /> Workers' on-site construction activities and shall retain full control over the means and <br /> methods of construction at the jobsite. City shall assign to LC Workers only duties which <br /> arc consistent with the LC Workers' skills and abilities as determined by LC. City shall <br /> have on-site personnel responsible for the supervision of LC Workers. City shall maintain <br /> thc construction site in a safe and hazard-free condition in compliance with OSHA and <br /> applicable state regulations. City shall also maintain thc workplace free from <br /> discrimination and unfair labor practices. City shall not request or require LC Workers to <br /> perform tasks which require driving a vehicle unless City delivers to LC, in advance, an <br /> insurance policy acceptable to LC naming LC as additional insured. <br /> <br /> <br />
