User Cafiegories: The determination of the appropriate user category for particular premises shali be made by City's Direc#or based upon fihe waste or wastewater constituents or characteristics of such user, including such factors as biochemical oxygen demand, suspended solids, and volume, consistent wEth the categories hereinabove in subdivision A established. The user cafiegory for any particular premises may be revised, changed, or redesignated by Authority's Manager with the consent of City's Director upon a determination by them that the waste or wastewater characteristics of the user of such premises have changed in such manner, or to such an extent, as to justify such reclassification. Any user, permittee, applicant, or other person aggrieved by a determination of City's Director made pursuant hereto may appeal such determination to Authority's Commission in accordance with the provisions of Sectivn 27.130, et seq,; provided that references in said Section �o "Authority's Manager" shal� be deemed to mean "Director." C. Payment: The charges established in subdivision A hereof shall be paid by fihe owner or occupant of the premises receiving sewerage service to the City Callector within thirty (30} calendar days after presentation of a bill #herefor, and shall be deemed delinquent �f not paid within said period. Such charges may be included in the City's water bills. D. Remedies. Upon nan-payment of the charge for sewerage service within the time specifred in subdivision C hereof, an action may be brought in the name of the City in any court of compe�en� jurisdiction against the owner or occupanfi of the premises to which such charge pertains far the co�lection of such delinquent charges. If the occupant of such premises is not also the owner, such action may be brought against both the owner and occupant, bath of whom shall be jointly and seve�ally liable for said charges. Water service to such premises may be discontinued by the City in the case of non-payment of the charges established in subdivision A hereof within the time required under subdivision C hereof. The remedies herein established shall be cumulative and in add�fiion to any and all other remedies available to the City for the collection of sewer service charges." , SECTION 2. This ordinance shall be effective thirty (30) days after its adoption. All residential and cammercia� sewer uti�ity bills generated on or after July 22, 2049, shall reflect the revisians in billing service charges and fees for the portion of the bifling period commencing on July 1, 2009 fio which the bilis apply. � � * Atty/Ord/Ord.322 3 051909
