By including the Triple Fl�p and#he VLF Back�ili in#he PTAF calcufation,#lie county collected add�tianal fees o#more than$4.8 miilion in FY 2006-07, and more than$5.3 milfion in FY 2007-08. Forty-seven ci#ies in Los Angeles County sued the county in 2Q08 seeking a change in how#he county calculates the PTAF. Las#week,#he Superior Cour#rejected#he cities'argumen#that#he county was only entit[ed to its actual costs of admir�istering�he Tr�p(e Flip and the VLF Backfi{!. The court noted that the Legislature had expressed an intent to more fairiy apportion#he counties' burden of colEecting property tax revenue,and further rtoted tha#the count�es' burden is a subs�antial one.The court stated that it is undisputed tha#the source of revenues to fund the Triple Flip and the VLF Swap is property tax revenue, and#here is nothing to indicate tha#tl�e LegisEa#ure intended#o permanently exclude counties from reeouping costs for colfecting this property tax revenue.Therefore,the court concluded that counties are entitled to inciude the Triple Flip and the VLF Swap in the PTAF calculation.
