By including the Triple Fl�p and#he VLF Back�ili in#he PTAF <br /> calcufation,#lie county collected add�tianal fees o#more than$4.8 miilion in FY 2006-07, and <br /> more than$5.3 milfion in FY 2007-08. <br /> Forty-seven ci#ies in Los Angeles County sued the county in 2Q08 seeking a change in how#he <br /> county calculates the PTAF. Las#week,#he Superior Cour#rejected#he cities'argumen#that#he <br /> county was only entit[ed to its actual costs of admir�istering�he Tr�p(e Flip and the VLF Backfi{!. <br /> The court noted that the Legislature had expressed an intent to more fairiy apportion#he counties' <br /> burden of colEecting property tax revenue,and further rtoted tha#the count�es' burden is a <br /> subs�antial one.The court stated that it is undisputed tha#the source of revenues to fund the <br /> Triple Flip and the VLF Swap is property tax revenue, and#here is nothing to indicate tha#tl�e <br /> LegisEa#ure intended#o permanently exclude counties from reeouping costs for colfecting this <br /> property tax revenue.Therefore,the court concluded that counties are entitled to inciude the <br /> Triple Flip and the VLF Swap in the PTAF calculation. <br /> The f�eague has been infiormed that the cities in this case are weighing whether to appeal,but as <br /> yet no decision has besn made.
