Any statements submitted to Lessor in the Lessee's <br /> Application for Courthouse Square Concession Space ("Appfication"} and this <br /> Lease Agreement by Lessee are considered inducemen�s to execute this Lease. <br /> Misrepresentations by Lessee shall ent�tfe �essar to terminate this Lease. <br /> 27.3 Entire Agreement. This Agreement contains aEl the terms, covenants, conditions <br /> and agreements between Lessor and Lessee relating in any manner to the lease, <br /> use and occupancy of the premises. No prior or other agreement or <br /> understanding pertaining to the same shall be �alid or of any force and effect; <br /> and the terms, covenants and conditions of this Agreement cannot be altered, <br /> changed, modified or added to, except in writing signed by Lessor and �essee. <br /> 27.4 Captions, Defin�t��!-�s and Severabiiitv. The captions of ihe sections an� <br /> subsec�ions of this Agreement are for convenience and easy reference only and <br /> shall not be considered or referred to in resolving questions of construction. <br /> Whenever �n this Agreement any words of obligation or duty are used, such <br /> ward� shal! haWe the same force and effect as though made in the farm of <br /> ° � covenants. All of the covenan�s and agreements herein contained are <br /> conditions, and the strict and prompt performance of each sha{I be canditions <br /> precedents fo the right or#o have this Agreemen# continue in effect. Nothing contained in this Agreement shalf be <br /> deemed or construed by the parties hereto, or by a third person, to create the <br /> relationship of princ�pal and agent, or of partnership, or of joint venture, vr o# <br /> trustee and beneficiary, or of any association between Lessor and Lessee, and <br /> neither any provisions contained in this Lease nor any acts of the parties hereto, <br /> shail be deemed to create any rera�ionship between Lessor and Lessee other <br /> than the relafiion of Lessor and Lessee. <br /> 27.6 Time. Time is of the essence with respect to the performance of every provision <br /> of this Agreement in which time of performance is a factor. <br /> 27.7 Notice.
