6.1C Page 20 27.2 Misrepresentations. Any statements submitted to Lessor in the Lessee's Application for Courthouse Square Concession Space ("Appfication"} and this Lease Agreement by Lessee are considered inducemen�s to execute this Lease. Misrepresentations by Lessee shall ent�tfe �essar to terminate this Lease. 27.3 Entire Agreement. This Agreement contains aEl the terms, covenants, conditions and agreements between Lessor and Lessee relating in any manner to the lease, use and occupancy of the premises. No prior or other agreement or understanding pertaining to the same shall be �alid or of any force and effect; and the terms, covenants and conditions of this Agreement cannot be altered, changed, modified or added to, except in writing signed by Lessor and �essee. 27.4 Captions, Defin�t��!-�s and Severabiiitv. The captions of ihe sections an� subsec�ions of this Agreement are for convenience and easy reference only and shall not be considered or referred to in resolving questions of construction. Whenever �n this Agreement any words of obligation or duty are used, such ward� shal! haWe the same force and effect as though made in the farm of ° � covenants. All of the covenan�s and agreements herein contained are conditions, and the strict and prompt performance of each sha{I be canditions precedents fo the right or#o have this Agreemen# continue in effect. Shauld any provision of this Agreement be adjudged to be invalid, void or ilfegal, such adjudication shafl in no way eftect, impair or invalidate any other provisions hereof, the par�ies hereto agreeing that they would have ent�red rn#o t�e remaining pvrtion of this Agreement notwithstanding the omission of the portion or por�'sons adj�dged invalid, void or illega�. 27.5 Relationship of the Parfiies. Nothing contained in this Agreement shalf be deemed or construed by the parties hereto, or by a third person, to create the relationship of princ�pal and agent, or of partnership, or of joint venture, vr o# trustee and beneficiary, or of any association between Lessor and Lessee, and neither any provisions contained in this Lease nor any acts of the parties hereto, shail be deemed to create any rera�ionship between Lessor and Lessee other than the relafiion of Lessor and Lessee. 27.6 Time. Time is of the essence with respect to the performance of every provision of this Agreement in which time of performance is a factor. 27.7 Notice.
