These must be demonstrated by (a) written <br />contracts; (b) capital outlay/financing program for delivery <br />adopted by Water Supplier; (c) Fed/State/Local permits for <br />dellvery Infrastructure; (d) regulatory approvals required to <br />conveyor deliver water. <br /> <br />The Water Supplier shall provide the Lead Agency "its plans for <br />acquiring additional water supplies, setting forth measures that are <br />being undertaken to acquire and develop those water supplies.. <br />Plans may include: (1) estimated total costs; (2) FedlStatellocal <br />permits anticipated to be required; and (3) estimated tlmeframes to <br />acquire additional supplies. <br /> <br />The governing body of the Water Supplier or Lead <br />Agency must approve the assessment at a regular or <br />special meeting and deliver the assessment to the <br />requesting Agency within 90 days of request. <br /> <br />Second: <br />If no water recelved in prior years by Water <br />Supplier under ~ems identified per First inquiry, <br />identify other water suppliers or water service <br />contract holders that receive supply or have <br />rights to the same source identified by the <br />Water Supplier or Agency. <br /> <br />Third: <br />If the SOUfce for the project <br />includes groundwater, factors <br />and specifications related to <br />groundwater source must be <br />included.7 <br /> <br />.- No <br /> <br /> <br />Q: Does the <br />assessment <br />conclude that supply <br />is 'sufficient"? <br /> <br />Based on conslderation of <br />these three areas, the Water <br />Supplier or Agency must make <br />a conclusion as to the Primary <br />Issue for assessment (above). <br /> <br />Yes <br /> <br />~ <br /> <br />Lead Agency considering <br />project shall include <br />assessment and any <br />additional supply <br />information In CEQA. <br />document for project. <br /> <br />Lead Agency "shall determine, based on the entire <br />record, whether projected water supplies WiD be <br />sufficient to satisfy the demands of the project, in <br />addition to existing and planned future uses." <br />"If the [Lead Agency] determines that water supplies <br />win not be sufficient, the (Lead Agency) shall include <br />that determinafion in its findings for the project" <br /> <br />The Lead Agency will approve or disapprove the project based on a number of <br />factors. including, but not limited to, the water assessment. <br /> <br />Chart Courtesy of the <br />The Building Industry Legal Defense <br /> <br />October 8. 2003 <br /> <br />Page vi <br />
