<br />7A <br /> <br />Common open space: The revised plan exceeds the open space requirements. ThePage 3 <br />common open space area will be designed as a green central focus area for residents' <br />use. The open space calculations were submitted by the applicant and are included in <br />the revised plans, and have been verified by staff. <br /> <br />Density: The project has been revised in terms of the unit type and count resulting in a <br />reduction in density. The onginal proposal was for 24 units, which included detached <br />single-family residences, a "duplex" unit, and attached townhouse-type units, yielding <br />15.6 dwelling units per acre. The project as revised consists of 21 units, which are all <br />detached single-family residences, yielding 13.6 dwelling units per acre. <br /> <br />Drainage: This issue was raised and discussed at the Planning Commission meeting on <br />April 21st and the June 1st Council meeting. The City Engineer stated that all <br />development must be compliant with all applicable codes and ordinances with respect <br />to drainage. In short, no new development can drain water into another property and <br />detailed drainage plans are reviewed in conjunction with construction documents. <br /> <br />Environmental Assessment <br />In April 21, 2009, the Planning Commission reviewed an Environmental Assessment <br />application for the proposal which included the preparation of an Initial Study and <br />Mitigated Negative Declaration (IS/MND) and determined that there would be no <br />significant effect on the environment per the California Environmental Quality Act <br />(CEQA). <br /> <br />Tentative Map and Planned Development Permit <br />A Planned Development Permit (PO) is also required to allow the construction of 21 <br />units with the proposed site configuration. Per Article 46 of the City Zoning Ordinance, <br />Planned Development Permits, "... encourage flexibility of design and development of <br />land in such a manner as to promote its most appropriate use... incorporate the highest <br />quality architectural solutions... and encourage the development of quality open <br />space..." while subjecting the quality of the project to higher standards. Because the <br />project site is greater than one acre, the Planning Commission has review authority and <br />subsequently approved the Planned Development Permit based on applicable findings <br />and subject to the conditions of approval because the proposal met the intent of the <br />Zoning Ordinance. The Planning Commission's approval included specific conditions <br />that required the developer to revise the plans to some" extent and were presented to <br />Council on June 1, 2009. The plans have been revised in response to Council direction <br />and the reduced copies of the revised plans are included as attachments. Full sized <br />sets are available from the Planning Division and City Clerk. <br /> <br />The Tentative Map (TM) was also approved by the Planning Commission at the public, <br />hearing on April 21, 2009 because it conformed to the City's subdivision standards. <br /> <br />Record Corrections <br />Staff reviewed the record to make sure the responses given to Council on June 1, 2009 <br />were accurate and clear. Two clarifications/corrections are needed. <br /> <br />1. When staff presented to the Planning Commission, how density is calculated for <br />properties located within the R-2 Zoning District, staff was not specific about which <br />aspects of the formula are from code and which are from interpretations. Rather, <br />staff simply presented it in a general fashion. <br />
