<br />Be <br />Page 17. <br /> <br />PUBLIC COMMENTS & PUBLIC HEARING: <br />Written correspondence regarding this project was received by email and U,S. Postal Service and has <br />been made part of the administrative record for this project for consideration by the Zoning <br />Administrator. A petition was also submitted on November 10, 2007 that was signed by five (5) <br />neighbors residing along Connecticut Avenue expressing that the operation of the school on the <br />subject property "has been and will continue to be detrimental to [the) collective peace and comfort, <br />and that [the school] will negatively impact the safety of the neighborhood due to dramatically <br />increased traffic." <br /> <br />A Zoning Administrator public hearing was scheduled for January 15, 2009, for consideration of the <br />Use Permit application. Notification of said hearing was completed pursuant to the noticing <br />requirements set forth in Article 42.5 of the City's Zoning Ordinance. Due to the level of publiC interest <br />in this project, the City extended the public notification by' sending copies of the public hearing notice <br />to all property owners and residents living within a 750-foot radius from the subject property (where <br />300 feet is legally required). <br /> <br />CEQA STATUS: <br />The proposed project is considered categorically exempt from the requirements of the Califomia <br />Environmental Quality Act Guidelines pursuant to section 15301 Class 1 (e){1) "additions to existing <br />structures provided that the addition will not result in an increase of more than 50 percent of the floor <br />area of the structures before the addition, or 2,500 square feet, whichever is less," because the <br />proposed project involves a net addition of approximately 1,236 square feet of floor area (after the <br />proposed removal of the existing Secondary School classroom building located at south end of the <br />subject property). <br /> <br />USE PERMIT FINDINGS: <br />The following findings relate specifically to the proposed school and child care facility functions with <br />the sole purpose of regulating land use issues associated with said uses, and are not intended to <br />regulate the religious affiliation or curriculum. Following review and consideration of the project <br />application, the testimony received during the publiC hearing of January 15, 2009, and all written <br />correspondence received to date, the Zoning Administrator has approved the application for a Use <br />Permit for the Woodside Hills Christian Academy project, based upon the following findings and with <br />strict adherence to the conditions of approval set forth below: <br /> <br />1. The establishment, maintenance, and operation of the proposed kindergarten through twelfth <br />grade school and child care facility uses will not, under the circumstances of this case, be <br />considered detrimental to the public health, safety, peace, morals, comfort, or general welfare of <br />persons residing or wor.king in the neighborhood, including the students and staff of Woodside <br />Hills Christian Academy. The majority of school activities on the subject property will be <br />conducted within the building. Outdoor uses will include outside dining and limited outdoor <br />recreation in designated areas, to provide for greater noise attenuation. The conditions of approval <br />limit the school and child care facility population to a maximum of 80 students/children overall and <br />further control various operational aspects of the use, such as vehicle circulation, trash/recycling <br />facilities, noise and outdoor recess and lunch areas. The individual station learning associated <br />with this style of education allows for multiple grade levels to be accommodated within a single <br />classroom, thereby allowing for a broader range of grade levels within the school. Strict <br />adherence to fire and building codes will ensure that seismic and other life safety risks are <br />reduced to reasonable levels found to be acceptable for school and child care facility uses. <br /> <br />2. The establishment and operation of the proposed use will not be detrimental or injurious to <br />property or improvements in the neighborhOOd because the kindergarten through twelfth grade <br />private school and child care facility uses are related to other types of public and quasi-public uses <br />that are permitted and currently present in the vicinity of the subject property. The subject <br />property is located within the Residential Single-Family (R-1) Zoning District in an area that is <br />comprised of a variety of land uses including single-family residences, a public elementary school, <br />public library as well as a church all within less than 100 feet from the subject property.
